i want to change my sons last name how would i go about doing it? preferably without an attorney

my son is 6 years old and im divorced from the father and the father never speaks to or sees my son

The information I'm finding online says that it depends on the situation...and that the name on the birth certificate will almost always have to stay the same. It says if both parents agree, the name can be changed from the mother's maiden name to the father's surname, but it cannot go reverse. It also says that you can do it by deed poll, but this would be involving the court and a judge would have the final ruling. Your best option is to call the court house in your area and see what they tell you. It sounds like the only way to actually change a birth record is if you prove someone to be the biological parent. Depending on your situation, it may be allowed if you are seperated from the father/mother, and the name hasn't yet been used for a lengthy period of time, or if it would make life easier on the child.

It depends on how old he is. Within the first year a name can be changed jsut because you want to. After that is takes a court order and they don't give those without good reason. You will also need his father's permission. If you want to do it, you should just be able to go to the courthouse and file some paperwork. They usually have like an information desk to tell you what to do.

I don't know what law states in this matter in your country. But in India, a son or a daughter of any person who has fathered him or her is bound to give his surname to that child, whether the child is borned with or without marriage, it doesnot matter. Only a woman has to prove that the father of a child is so and so person.

Call the courhouse in the county that you reside. They can answer your question. Each state and city has diffrent laws so you need to start there.

oh you cant do something like that, you need to go through a legal process.. and i think you can only change your last name if it happens to be demoralizing
