Of course not, Cats can have up to 5 tons of catnip without getting busted.

Again with the legality issue.
IF catnip were illegal in amounts of 3 tons, no, your cat wouldn't get busted- felines aren't considered legally culpable (can't be held responsible for any actions in a court of law), but their human owners are... which means that you're oh, so lucky that catnip isn't illegal.

Is catnip illegal in your country? Oh, I get it - it looks like marijuana when it's dried - in that case the cops (or drug-sniffing dogs) need only sniff it to tell. They can steep some in hot water and drink it like tea if they want to, too; it'll do them better than the weed and help ease tummy aches.
