HELP! I got a bunch of infractions~for my dog?
I've been harassed by a neighbor for 3 years now. He's constantly calling animal control saying my dog is on his property. The don't even ask questions and write up tickets in the $100 increments for Roaming etc. They have no proof that it's my dog, yet, the ticket is still issued????? Is this legal???

My dogs were in my house at the time they said this occurred. Apparently, they are saying "they saw them" and that's proof enough.

i would keep my dog inside and use a leash when taking outside , also why would animal control issue tickets without proof ? the neighbor must have something on your dog . you can press charges for harassment if you have proof your dog never runs loose

If you feel that you are being cited and you believe it to be unwarranted then your only recourse is to contest it in court.
Another piece of advice is to either keep your dog in a fenced area on your property (if this is feasable) or chained and not allow the dog to roam. Know that if the dog gets struck by a car you're responsible for damages to the vehicle.
Issuing a ticket is legal. There are some departments that have the ACO take a brief field statement from the complainant. If you do take it to court then the state's attorney can call the complainant in under subponea to give testimony as to their complaint.
Just ensure once again your dog is licensed and is current on shots and you have taken every measure possible to keep the dog in your yard and not roaming.

"They have no proof" that it's your dog. When someone says "prove it" they generally mean they are guilty and doubt that the witness can offer any facts to back up the witness statement.

You have the right to fight the tickets in court. If you are innocent, you can go that route. Your biggest problem will be all your previous non-contested tickets and encounters with animal control.

They way I see it you have 2 options

1. Fence in your entire yard (or use invisible fencing and shock collars) and the next time Animal Control knocks on your door, show them your dogs cannot get out.
2. Have video cameras installed in your home and fight the tickets taking the tapes to court as your evidence the next time this happens. Make sure the time and date stamp is permanent and cannot be altered.

Good luck, having rotten neighbors is a horrible experience.

put your dog in a fenced in lot then it can not be your dog.
