I've been harassed by a neighbor for 3 years now. He's constantly calling animal control saying my dog is on his property. The don't even ask questions and write up tickets in the $100 increments for Roaming etc. They have no proof that it's my dog, yet, the ticket is still issued????? Is this legal???

haha, xx that made me laugh and i needed that. My dogs were in the house! We don't have a leash law in my town, however, they can't roam on other peoples property, however, they're SAYING that they SAW them. Impossible, they were with me. They just keep harassing me and I keep getting issued tickets. THEY'RE FRIENDS WITH THE MAYOR

AND HE LIVES 2 MILES AWAY-CARRIES A RIFLE AND CONSTANTLY SAYS HE'S GOING TO SHOOT MY DOG. AND, THE PEOPLE THAT LIVE 6 HOUSES DOWN FROM HIM HAVE AN IDENTICAL DOG AS MINE

The people with the identical dog also had problems with this guy. AND, I did make Animal Control and Police aware of his gun totin antics and guess what? He's allowed to threaten and actually shoot my dog with his rifle on his property. However, yesterday, he was on his quad in the woods behind me looking to shoot my dogs. THAT is def against the law. I feel like I cannot get any justice. My dogs are on an Invisible Fence.

Put up a fence or put in a tie out. The next time you get a ticket, get a picture of your dog, then get a photo of the neighbor's dog that looks like yours. Go to court, show the judge the photo of your fence and/ or tie out and the photo of the identical dog. I would also talk to the animal control officer as well. Officers are just doing their job and are not being malicious.
I sort of had the same problem with a neighbor once, but she was an alcoholic. She would call me and yell at me saying that my dog was crapping in her yard, she was calling the dog officer, etc. I would be staring at my dog and telling her,"it is not my dog, I am looking at her right now". I finally ended up calling the dog officer and showed her the dog that looked like my dog.Showed her that my dog would never get 2 feet from me, and explained that the woman was always drunk. That took care of it. This guy sounds nuts too. You might want to mention to the dog officer that he carries a rifle around and is threatening to shoot your dog.

P.S. OMG that is so scary!! Did you call the police about him lurking about with the gun??? It sounds like this guy has paranoid personality disorder or is schitzophrenic or however you spell it. I would really start keeping a log book of everything he does and def. call the police if you see him with a rifle near your place. If you have a friend with a video camera, I would borrow it and be ready for him the next time he is lurking around trying to draw your dogs over so he can shoot them. After getting the evidence, I would talk to an attorney as well.....People like that are so unpredictable and irrational that there is just no talking to them. If he keeps this crazy stuff up long enough you might be able to get a restraining order against him. God bless you, what a nightmare!!!
oh, any way to put up a privacy fence across the back of your property? I know they are expensive, but sheesh, this guy is nuts!

Most towns have a leash law. If the animal control officer comes by and see's your dog roaming around then he's going to believe your neighbor. You can fight the tickets by going to your city hall. Check your local laws about the leash law that requires that a dog remain on a leash at all times. And tell your pesty neighbor to put a fence up if he does'nt like animals like the rest of us. An animals feccul matter is biograble and will break down good lawn fertilizer. Just tell your neighbor be thankful you don't own a cow.

All towns have a leash law. Just because someone claims they see your dog but have no proof they can not write you a ticket. Fight the tickets. As every ticket you get is not just a fine it becomes a legal misdemeanor on your criminal record. It they have captured the dog on their property or the animal control has then you are responsible for this animals actions. Otherwise they can not do what you are saything they are doing legally.

Write to ALL of the members of the city council. Nicely and with careful wording. The Mayor doesn't have absolute power.

you have the right to get an attorney, and file harrassment charges. it may sound a bit extreme and may or may not help, you stated there is NO leash law in your area, but is there a state leash law ?
