My brother statrted attacking me and getting in my face. He wouldn't let me past him and kept lunging at me like he wanted to hit me. He did punch me a few times and I scratched him in self defense. I am 20 years old and about 200 lbs, and 5;2', he is 16 years old, 210 lbs., and 5'10'. What do I do? He keeps threatening to kill me, and break my stuff when I'm not home. I want to talk to the police because I don't feel safe in my home, and he has a record. But since I'm older and he has 2 scratch marks, I'm afraid that I will get in trouble. Any advice?

File a police report. He has no right to make you feel threatened in your own home. You're the authority and he is the child, he should learn his place.

No you are not going to be in trouble but it sounds like you and your brother are having a hard time co-existing under the same roof. I think it is time you guys really had a good talk, I know its sounds cheesy but this is unhealthy to be getting violent at the age you two are. See what you can do to make the situation better. 16 can be a really hard age and maybe he is just going through some stuff and it is coming out as anger. Try to be understanding of that. 20 is a good age because you are more mature and responsible, It things get heated again don't argue because it is a waist of time but just say man I love you and I don't want to fight so I'm sorry for what ever I have done, and walk away. Don't add fuel to the fire, try to remember you do love him and take the higher road. He will respect you and back off and maybe you guys can really start having fun together.

You 2 are 4 yrs apart. You 2 are brother's you may not get into as much trouble as you think but don't take advantage of it. Where are your parents through all of this? If you really feel there may be a problem talk to them and ask. They will be straight with you. Do you have a job? Can you get out on your own? Good Luck

I doubt scratching in self-defense could be compared to assault. How much weight the scratches would hold would probably depend more on the severity and location of the scratches, however, since they were in self defense, you shouldn't be in any trouble. If you can afford it, I'd get my hands on a lawyer's opinion and go to the police as soon as possible.

Call the police. Don't be afraid, whatever you do. You have to deal with this. They won't blame you for defending yourself from a 16-year-old boy.

thats sad for brothers to be like that .....but if i were you call police if he attacks you again maybe he needs help of some kind ...dont fight back you will end up going to jail ....he sounds out of control ,,,iam a mother 3 boys they have their fights at times ,,,but the older they get the more mature..good luck....hope everything turns out good...

If you feel that you are bodily threatened then you should talk to the police. You will at least have it on record.
