Very few people get approved for disability benefits based on the HIV+ alone. Most HIV people I've represented were capable of daily living (most days) but had severe side effects with the coctails (diarrhea being to most common). I've had clients approved on the basis of bowel incontinence!

Social Security disability is not just a medical determination, it is how your medical condition (which must be well documented in the medical records) and such have effected your vocational profile. Think about it, if you have to go take frequent unscheduled work breaks of varying time, are you competitive in the labor market!?!?!?!

The applicaiton process is pretty simple, call your local SSA office, do it yourself online, or (preferably) hire an attorney to represent you from the start.

You would have to document disabling symptoms related to HIV. These could be either physical or mental. I don't know where you are located. In San Francisco there is an organization the "Positive Resource Center" that has attorneys who specialize in obtaining benefits for persons with HIV in San Francisco. Even if you are not from SF, perhaps you or your attorney (if you don't have one you may need one) can get information from them.

Just being HIV+ wouldn't be enough. A lot of people are HIV+ and still work. I'm sure it would have to have developed into AIDS and be at a point where the person cannot work anymore.

A lot of people with medical issues work. They expect me to work and I'm partially disabled, but don't meet the requirement for Soc. Sec. because there are still some things I can do, at least for now.

The discussions I have had with other members of my support group indicate you (literally) have to be on death's door to get Social Security Disability benefits. As mentioned before, if you are not clinically classified as having AIDS your possibilities are greatly reduced. This is a question, I have often wondered about myself (I have AIDS), but I'm not sure I would qualify. Physical and mental factors have to be documented or you won't have a chance.

i got disability for HIV they give it to you after you past the 10 year mark or that is the way it happen for me
