While some one was loading her stuff on her car at the Costco parking lot, her back was turned against the cart, it rolled and damaged my car leaving a dent and a few scratch (estimated $350). I thought the person wanted to deal this issue in person-to-person, but she was not being cooperative. She told me she made a claim on costco (I don't how this could happen but..), and I made a call to costco and I found out that no one by the name of the person had made such claim and that if the accident was not by the employee, such claim could not be made on/against costcos. She gave me her insurrance number, which proves that she admitted her mistake at first. However after a few days, she ignores my phone calls and shows no effort in solving this case. Even her auto insurance does not cover such accident. Should I just notify her property insurance, or should I file a case on small calim court? Help me, please, I want to resolve this problem.

Small claims. Get the video recording from cosco too.

Generally even if she had liability coverage that should coverage damage to your veh. You can pretty much rule Costco out most dept stores, and other retailers have clauses on there insurance stating they are not responsible for damage caused by shopping carts to autos. If she is ignoring you I would recommend filing a self police report at your local pd in the town where incident occurred, and take her to small claims. Also depending on what type of coverage you have with your insurance you may want to file with them, and they may be able to contact her insurance for you to get reimbursement. That is if you have at least comp, and coll coverage.

I used to work at Sam's Club (Costco's rival). A shopping cart hit my car one day due to wind. The store itself will never pay for damage. You should be able to make a claim with your own insurance company and tell them the wind blew it towards your car or it rolled down a hill. Your premiums might go up, but that's up to you whether you want a higher premium or no more dents. Good luck. I know it sucks. She probably won't cooperate so I'd say just leave her idiot @ss out of it!

this has happened to me,you need to call your insurance agent and he or she will fight for you,thats there job. It may take a while but eventually they will resolve it for you,thell even let you fix your car under your insurance for the time being untill the caes is resolved and then when you win youll get your money back for the deductable and time lost.its the best way to handle it small claims court will just drag on and if she doesnt show it will take even longer.

Yes, take her to small claims court. Take pictures of the damage, estimates, her insurance info and any other proof you may have with you to prove that she admitted guilt.

get a local lawyer and have them look at the dent and stuff and see what he/she says would be best to do.. which would probably be to go to court and if they hear a threat to go to court most people would be willing to pay twice as much as needed rather than going to court

Worst case scenario, contact the police. Don't do that, though, unless you are completely void of all other ideas.

do both make a claim to insurence and take pics and take her to court its not that much money she should just pay. do what evr you can. man that must suk tho. sorry!!!
