Whose fault was it that these people, who were illegal, had jobs? The people at Swift will argue all day long that the workers had legal documentation, but they had to know. How else would they be able to hire them for less wages then their union counterparts in the same plant. This wasn't just a one plant occurence, it was prevalent in six different states!!! You can't tell me that management is that stupid.

The problem, right now, is that the only thing an employer has to do is complete the I-9 form from the DOJ. In order to be hired, an employee must present a form of acceptable documentation to the employer. Usually, this is in the form of a driver's license or ID card, and a social security card. Unless it is clearly evident that the ID's have been faked (which an employer cannot tell since they have not been trained to spot ID's, thus it would be illegal for an employer to declare an ID as a fake), the employee is hired, and the I-9 is sent to the DOJ for verification. In hiring a lot of employees, I have never heard from the DOJ once.

So, the question is, how to you arrest management if they have performed their job & were unaware that the employees were illegals? Short answer - you can't.

How to get out of this Catch 22? Simple - make it federal law that ALL new hires MUST undergo a background check. That would be a quick way to see if there was a problem, or if the employee was using a stolen ID. However, this would result in a large amount of cost, as every government agency that produces ID's would have to be interconnected into a large database for easy access (this raises privacy concerns), and employeers would pass on the cost for all background checks to the customers.

To finish - you are correct, management is not that stupid. They probably knew. However, proving that knowledge is a court of law is very difficult.

BOTH!!!!
I hope ICE raids TYSON chicken, as well as all of these Mexican markets that hire illegals too!
Managment KNOWS that these illegal mexicans buy fake socials and I.D. They hire them with those fake documents, then when ICE raids them, they claim they had nooooooooo idea they were fake. PLEASE!!!

I have previously worked for employers that encourage the illegals and even tell them where to go to buy the fake papers, AND when social security, after tax time, sends a letter sayin that the name dont match the social, they tell Jose to go and get a new name/number.

Now it is common (as most of the Swift illegals did) that they buy a real social that matches the name of a real working american citizen, and this is how these illegal mexicans buy homes, and cars etc...

ICE doenst catch on usually unless some investigation is done, because since they buy a good number ( some americans number that is retired, or is unemployed, or a minor etc..) and so when the employer turns in the tax info for that social, nothing bounces back sayin that the number doesnt match the name.

They can use a number for many years and not get caught. This is the new way. The old way is that they would just make up a number of the top of their head, and after tax time the employer would get a letter sayin that the name and number dont match.

I have seen this happen sooo many times! Management covers their butts by claiming they had noooo idea what was going on, and that all they know is they saw a social security card, and I.D that matched the face of the person.

I know for a fact that when the illegals come here the first place they go is to Chicago to get a Social Security Card so they will have documentation to show the people that hire them . They were told when they filled out applications for jobs and didn't have a SS card , who they should talk to to get one and how much it would cost . A man would go to Chicago and get them by the dozen . I would see them gathered together and being handed cards that they were paying for . It's well known and you can't tell me that Swift doesn't know as well as most other employers that hire illegal immigrants .
They aren't catching and fining them , because the Government doesn't want them too .
Yes they should be raiding all the meat processors and about a hundred other places

yes they should have arrested the illegals, the management, the union leaders for selling out the legal citizens and the best way to get point across that it is not alright to break some laws in the USA and not others should be brought home to the law breakers be they illegals or management perhaps if citizens got together and decided to boycott all swift company products

Well yes they should be raiding companies, but we should have seen management in hand cuffs also, NOT just the illegals.
Both are to blame, the illegals know what they are doing is against the law, and the company knows what they are doing is against the law, but once again greed wins out. Any company that hires illegals should be Fined a very heavy fine, and in this case and other cases just as bad jail time.

YES, Raiding is a good tactic, in my opinion companies that hire illegals are crooks, not only do they break the law be they abuse the illegals they hire, even if they are also breaking the immigration laws, they have basic HUMAN rights!

OK....First tell me who'se fault is is that some of these illegals at the Swift plants are engaged in a criminal conspiracy by running a phony ID ring.

They were producing and selling phony ID's and social security numbers.

THAT is what these raids were about.

Both but I have to say it's a useless exercise until the government gets serious about controlling the border.
