Should we get his licence back before we go will he go to jail please help I just cant find any information that will help me Thanks guys!

113 in a 75, on a suspended license, he is going to jail unless he can beat some of the ticket!!

Here is the answer from an ex-cop [32 years]. Yes we all know he was dumb so we won't beat him anymore. Beg for forgiveness. He has no excuses so don't try to come up with one, they will all make him look stupid. There are many unanswered questions here. If he is 17 he is in a worse situation than if he is 30 with an otherwise good record. What is he suspended for? If it was failure to get a taillight fixed not too bad, if it was his 5th DUI not good.

You need a, no he needs a plan for the future. If alcohol is involved get him in a program of some sort BEFORE court. Find people who will attest to his wonderful character. Go to court dressed well and be humble. If he walks in with an attitude he will lose. Be ready to tell the judge about how well he is doing at work or school, how he has organized the community around the weak and poor and how he is going to college to become a cop.

Wow. I'm surprised that your boyfriend didn't get booked on this one. Based on the information that you provided, I am assuming that the car he was driving got impounded for 30-days.

At minimum, this is what will happen:

1) Your boyfriend will be subjected to a hefty fine. I looked at the Superior Court Bail Schedule. The suspended license has a $5,000 bail amount + penalty assessment, and the speeding 26+ MPH over the speed limit shows a minimum $350.00 bail amount + penalty assessment. This one is off the scale, so maybe a little bit more.

2) If the vehicle was impounded, your boyfriend will have to pay the tow fee, plus the daily storage rate. Just about $3000, if you consider that the tow company stores at $100/day. Don't forget the vehicle release fee charged by the impounding agency, about $60.00.

3) License re-instatement? Your boyfriend won't be able to get his license until the Court rules that he has satisfactorily paid all outstanding fines, and he has to pay DMV a re-instatement fee.

So, no jail time, unless....your boyfriend violated his parole / probation in this incident, fails to appear for his court appearance, or fails to pay any fines.

Here's some personal advice: Look how much this going to cost. I am almost certain that he is going to ask you for money to help him with his legal troubles. Don't let him suck you dry like that because he is going to keep doing it over, and over again.
Either he is going to eventually run you into financial ruin, or drive you right into a lightpole one day. Try explaining that one to your family when that happens.

Get a lawyer. If the cop wrote the ticket for exceeding 100 mph, that is very serious. 99 and below is bad enough, but he broke the magic number and it's going to be painful, whatever the judge decides

Due to the supsended license, your b/f is probably gone spend some time in jail. Forget about the license -that's the least of his problems. He won't be driving anywhere soon.

That is better then 25 miles over and it is a serious traffic violation. He will loose his license and then become barred from driving for a period of time. If this is his first violation then it might not be so much punishment, but if this is more then his second offense, he will be barred and a hefty fine. Continue on with this serious offense, he could get jail time. It all depends on the Judge. He should give Thanks unto the Lord, that he did not collide with another vehicle and kill someone or one of his passengers. He is driving and it is a priviledge to drive a vehicle. Continue on his path of speed , he will be denied a priviledge that he won't be able to get back.

Is your boyfriend a complete idiot? Sounds like you know how to pick them. Not only doing 113, but on a suspended license. You are screwed.

He will not be getting his license back any time soon, and will probably be charged with reckless endangerment, possibly criminal negligence, along with a whole other host of charges. Will probably get probation, but I doubt he will go to prison.

My advice: dump the loser. And trust me, he is a loser. Don't make it your problem, and don't worry another second about it. It is his problem to deal with. Looks like it will be a lot of Saturday nights at home with the folks, you prepared for that?

well he has a suspended licence and so what might happen is that he will not be able to get one for a long time. depends on if this is his first time or what they call a habitual offender (which means this is his 3rd time). and it depends on what the laws are in ca..you can call the local court house and ask them what might happen. he might see a little jail time

He is going to be in more than a little bit of trouble. getting his license back now will do no good since he was suspended at the time of the offense.

About the only way to help you is to advise you to find a non-loser boyfriend.

I seriously doubt he will go to jail. Probably get another suspension on his license and maybe probabtion - but I doubt even probabtion unless this is like the third or fourth driving while suspended. Heavy fine for sure.

He may get some jail time, and he will definitely get a fat fine. He'll be lucky to get his license back for a while, because that's a losable offense, and he'd already lost it.

Maybe he should just take the freakin' bus. People that drive like that kill people everyday. I vote for the bus.
