I am looking at form 1040 for 2006 (to be filed in 2007), and there is no line for Tuition and Fees Deduction (was line 34). How can we claim this deduction this year or is there no way to? :(

A lot of us are waiting to see what is happening with this.

Officially, the deduction expired as of 12/31/2005 and congress didn't take up the issue until (quite literally) last week. I believe both houses of congress extended the deduction but the President has yet to sign it.

Unfortunately, the IRS has already designed the 2006 forms. They may just have to redesign them now.

So, officially, right now there is not a Tuition and Fees Deduction for 2006 but that may change by year end.

From IRS pub 970: If your are claiming you possess exemption and so they paid the school, then "NO ONE" is permitted to assert the deduction. They cannot for the reason that they did not declare you; you cannot for the reason that you did not pay it.
