i have a family member that receives $149 per month for two children and we all know that doesn't cover gas per month. the father sells drugs and the officials knows about him.

~Yet another dead beat dad. That is a pathetic amount to be even called "Child Support."
Who are the officials? Can they prove he sells drugs, making extra money? I certainly hope so.
My ex is another dead beat dad who has worked under the table AND drew unemployment. The only way I got Child Support is because I knew he was drawing unemployment.
He's a meth addict/alcoholic/womanizer who could care less about anyone but himself. Now Support Enforcement can't even locate him to tell him he'll be held in Contempt of Court if he doesn't start paying!
Support is based on his income. I WOULD get over twice that amount for 1 child, if he paid it. I feel really bad for your family member.
By law, the employers are supposed to check to see if they're supposed to be withholding money from his check but don't.
You can bet that that dead beat dad will eventually get caught selling drugs, unfortunately, that won't help her get her support. You can only hope that will straighten him up.
When he's on Parole, Support Enforcement can talk to his Parole Officer to find out where he is and where he's working. You can give his PO information about him, but all that PO can do is listen, it's still a way of getting him to clean up his act.~

Knowing someone sells dope and proving that someone sells dope is 2 different things.
There are standards that the judge has to go by when he sets the amount of child support. In most states, they can only take up to 40% of the "reported" income of the parent.

Hopefully, at least this is a warning to your other family members to be careful. Don't have sex with any man that cannot support a child. By the way, that is why there is an institution called "marriage". This way, you can get a home established prior to having children.

I think that child support stipulations are necessary to make fathers accountable for the children they bring into this world. Unfortunately, the judge can only set it's parameters on the money his is legitimately making through legal methods... otherwise he would be held accountable for his street pharmaceutical dealings. My father was only mandated to pay 80 dollars for THREE children per month, and of course he couldn't pay that ether... but all the same, it was recognition by the government that he should contribute SOMETHING!

Normally both parents are required to fill out a sheet that shows there income and a judge basis the support amount on the percentage of income received by both parents...unfortunately if the father who deals drugs does not show a whole lot of legitimate earnings the judge has to base it on what he reports...it is not fair but that is how it happens.

Well if they didn't set child support orders your family member wouldn't' be getting a thing I'm sure from a man like that so at least she's getting something even though it seems so unfair to her. I'm sure if she's in a bad situation she could always get other help if she looks into it.

His selling drugs is not going to increase his child support. That is illegal money and if he does get busted, none of it will go towards his children, it will only help to put him in jail.

Child support is a legal way to force parents to do what they know they should be doing anyway. It is sad when someone has to force a person to take care of their child(ren). But in essence many people with child support orders still dont pay. It is amazing how some people will even quit a job in order to not have it taken out of their checks.

There are way too many varities of contraception on the market for people to keep having unwanted children. It is one thing to not know but something else when you know but still get yourself in a totally avoidable situation. I dont have any sympathy for people who are selfish and only think of themselves.

Since he doesn't probably report his drug earnings to the IRS, there isn't much they can do.

They set the amount based on a 40 hour minimum wage job.
