In California do the police have probable cause to pull you over for not wearing a seat belt?

~Yes, even if the only thing you aren't doing is wearing a seat belt, they can and will pull you over in hopes that there's something else they can fine you on.
You can go to the DMV and get a form to fill out, if you have a valid reason for not having to wear a seat belt, such as health reasons (belt is too tight), you may not have to wear it. I would guess that you would have to carry that piece of paper with you everywhere you go, even if you're a passenger. Be aware though, you'll still get pulled over. ~

This used to be a "secondary" offense in California (10+ years ago). Motorcyclists lobbied the state because helmet laws were primary offenses while seat belts were secondary. They wanted helmet laws ruled as secondary offenses as well. Instead, the made seat belts a primary offense. You can be pulled over for the actions of your passengers. Seat belts, littering, throwing lit cigarettes out the window, etc. As for seat belts, the public safety issues outweigh the driver's inconvenience.

They do have probable cause to pull you over if they wish. But with the way the world is today I don't think the police even care if their neighbor is being beatened, raped, harrassed,or even threatened. It is the law in every state to wear a seat belt, but they only ticket you for it if they decide to pull you over because they haven't made their quota for the month.

I've wondered about this too. I know that if i get pulled over and are not wearing it I get a ticket. BUT if I'm not doing anything ... can they just pull me over if they see my belt is not buckled? Is that is the only thing they noticed - can they pull me over?

they pulled me over driving through west virginia because the officer couldn't see the black seta belt on my black shirt. no ticket, i was wearing it, he couldn't prove i wasn't. I always wear it, even though I hate it. Why? I read my life insurance policy, which I carry enough to pay for my house for my wife after I'm gone, Get killed in a traffic accident, no seat belt, they don't pay. That was reason enough for me to buckle up! I'm betting a lot of people don't consider that.

Your fair game if you don't have a seat belt on. People are getting busted for other things cause they're too stupid to put on a seat belt. Are you one of those people?

Yes. CA has a seatbelt law. You wear it or get pulled over and get a ticket. Where've you been?

Yes. More and more states have a Click It or Ticket policy. Alot of them have signs and tv ads too. Pay attention.

all of you are crazy I want to see the law code that give the right to violate my constatostional right. I do not care how long you are a police officer show me the law code.
