You don't actually have 'custody' of your child until you go to court and have an order put in place.
However, since you are above the age of 16, in some states, when you have a child, you become a legal adult and any custody arrangements over your are nullified.
Mind you, this is in SOME states, not all of them. But regardless of whether your mother has technical custody of you, she does NOT have custody or guardianship of your child.

Yes there is a way to be considered an adult at ur age. U have to prove to a judge that u r an independent person and that u r able to support urself, but it is possible..I think that u should talk to a judges office and see what u can do..

Once you have a child you can be legally responsible for yourself. You can move and and be considered a adult. If your mother fights this, you can just tell the court system that you can't be in the household because its a unhealthy environment for your baby. At least that's the way in worked for me in FL.

Yes you can actually but you have to go through the courts and your parents have to approve and sign that they understand that they do not have custody of you.

If you can prove that you can support yourself, in most states you can be emancipated at 17. You'll need to take it to court though.
