Been married for 2 mos. but living in for almost 5 years. Was not able to apply for petition due to death of the husband who was an American citizen. Is she entitled to claim benefits in the U.S. He was a pensioner. Can the widow get the monthly pension of the deceased husband?

No she cannot. For one she isn't an American citizen and has only been married for 2 months. To even get citizenship you have to be married longer than 2 years. Just because he was an American doesn't mean she is entitled to his benefits. Now, if they had a child together that child will get the benefits or actually a portion til he is 18 .

No the marriage was not long enough to allow for the benefit. They had to be married for much longer than 2 months and the time lived with but not married doesn't apply.

The marriage lasting only 2 months would not even have been long enough to apply for the pension had she been a citizen.

I think you have to be married for so many years to draw someone else's pension.
