I guess that the real answer is "yes", as the Constitutional protection to free speech applies to the investigator as much as to any other citizen.
That being said, it is highly unprofessional and if I was offended, as you seem to have been, I would contact his supervisor first, and if I didn't feel like he was going to address the problem, I would contact the Internal Affairs office to file a complaint.

Is not agains the law to curse.....at least here in TX. Although him being an investigator should have used a bit more tact and IPC skills especially when children are present.
It would look very unprofessional for him to do so. You should have estated that his kind of language in front of children was not appreciated. Sometimes us too although being cops are humans after all, and we do need a reality check every now and then.

You need to give more details. In most situations its not against the law. There are situations where it would be warranted and others where it would be just unprofessional.
Did he (insert swear word here) you? Would probably not be warranted.
Did he say he was going to (insert swear word here) you? Would be necessary to prove a crime.
So there is no absolute yes or no to your answer.

Not against the law. But there is probly a directive stating that they shouldnt. Not enough to get the guy fired but would be put in there file.

Get over it. That's all you've got to complain about? It probably wasn't the best thing to say, but there is no legal recourse. You could file a complaint with the department and screw up his career, forgetting the fact that cops are human too and also have 'slips of the tongue.'

There are still some states where it's illegal to swear in public, it shouldn't matter who is doing it. I think you'd have to check with your local library archives for a listing of old laws. Ask someone there, they might be able to help you.
