That depends. Did someone in the house write to him and ask him for something? If so then he is an invited guest and the milk and cookies are refreshments provided by you, the generous host. I doubt the police would arrest him or they wouldn't get any presents, either. They would probably tell him to "move along", but don't expect to find much under your tree in future years, Scrooge...

I, personally, am more concerned about the reindeer poop on my roof...

Nope....he can't get arrested because he's not breaking and entering...He has a standing invitation to visit once per year. He's not stealing the milk and cookies. Those are the complimentary refreshments provided for his comfort after working so hard to get down the chimney, or through whatever entrance he can find if a chimney is not provided, and putting all those presents under the tree.... If milk and cookies are left in a conspicuous spot near the fireplace then it could be assumed that he was an invited guest, therefore he could not be arrested for burglary.
If Santa was in your house as a guest and refused to leave after being told to do so by a law enforcement officer he could then be arrested for tresspass after warning.
If you do order him to leave, just make sure you do it after he puts the presents under the tree.

Well Legally in the UK for burglary he must have the intention to steal, commit criminal damage, rape or harm any person contained there in the building.

If he commits none of these then it is civil trespass and the police will not arrest him.

No, because my son wrote him a letter saying he can't wait for him to come on Christmas eve and told him he was leaving him milk and cookies...
