Uh no, but you can file a complaint against the officer. Most likely, they will come up with a reason why they were able to search the car. As in if they saw something in plain sight that looked like it could be a weapon or drugs etc.

First of all, try putting your hand on the cop to arrest him and see what happens. Making a citizen's arrest works best when the officer has a K9. :o)
Secondly, the police are not committing a crime when they do an illegal search unless the officer was intentionally doing an illegal search. 99.9% of the time, judges and lawyers argue for hours over the legality of the search. If it takes people with law degrees that long to decide, how would you expect the officer to know on scene?
Finally, if you or your property is searched illegally, your recourse is the suppression of the evidence once you get to court. For all the drug users reading this, that means it can't be used against you.

I have never heard of a single successful citizen's arrest ever on anyone. So I wouldn't attempt it on a cop. And if your car is illegally searched, bring it up in court and your case will be dropped.

No. Plain and simple. All you have to tell an officer is that "they do not have your consent for a search at this time". Otherwise if you let them, it is legal. If they see something in plain sight that warrants further investigation (concealed weapons, drugs, etc.) the search is legal. A cop can not search your car for no good reason, and if they do then you can file a complaint. But don't waste your time.

No. You can try, but you're most likely to get your as$ kicked by the cop's knowledge of joint manipulations and pressure points, baton, pepper spray, and gun. And then even if you do end up slapping the cop's handcuffs on him, two things will happen: his cop friends will proceed to kick your as$ and you will be charged with assault on a police officer.

You will be allowed to file for a lawsuit --AFTER you prove that it was an illegal search.
In the mean time I think the police offcer would have a nice place to store his night stick.

no, b/c in order for a citizen's arrest, one of the requirements is that the crime has to be a felony. illegally searching your car, is not a felony

only if your stupid. vehicle searches were found to be legal, in almost all circumstances, by the u s supreme court a couple years ago.
