A police officer can search your vehicle if the see something in plain view that would indicate the presence of contraband. When you are pulled over, and you give an indication of any type of intoxication, the Officer can do a search looking for drugs or Alcohol. If a drug dog alerts to your vehicle, then the Officer has the legal right to not only search, but they can also dismantle parts of your vehicle to locate the contraband!!

During a traffic stop the police have the right to look over your vehicle to assure their safety and can act on any contraband that is within plain sight. In order to conduct a search, the officer must have probable cause, a reasonable belief that a person has committed a crime. If the officer feels that they cannot establish probable cause for a search then they can ask your permission to search the vehicle. If your asked and do not want to be searched then politely say no. If your vehicle is searched without asking then the officer must prove the probable cause he used to conduct the search.

Usually if an officer asks to search your car they already have a feelin that somethings not right to begin with. Also if they ask you and you say no they may just call in a drug sniffing dog and then you're really in trouble if the dog hits on it. and if you're on a Military base and you say no you might as well get use to either a. hearing to bad b. to bad and a search and then an escort back to the exit of the base. Usually when a reg. officer not an MP request it they already have a sneaking suspension and most of the time also ask to see the reaction of the person who's in the car or your passangers. Best way to avoid this worry is not to have anything in the car for the officer to find in the first place. Then you wont have to worry about the question.

No they cannot it is stated in the Fouth Ammendment. What the Fourth Ammendemnt basically is The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized. They need a warrent to search anything without your permission or probable cause.

Yes and no.
A cop can search the car if they have reason to believe you are hiding something (if you shot at a cop, they would search your car for the gun once you were arrested, obviously), or if they see something in plain sight that warrants further investigation.
All you have to tell an officer is: "I do not consent to a search at this time". They can not search your car for no good reason.

The term is Probable Cause....Anything in "plain view" that gives the officer reasonable suspicion that there is illegal activity they can. But they cannot go into a locked glove compartment or anything like that. But if in course of you going to Jail for say...Suspended license there is a vehicle inventory and if anything is found it would be admissible in court cause of search incidental to arrest.

If the officer has probable cause to believe that a crime is being comitted, the officerr can perform a warrantless search. There is not much you can do to stop someone with a gun from doing what they want, but you do not have to give permission, if you don't want to.

Technically, they need probable cause. Which, depending on the officer, could be anything. The best way to stop them from searching your vehicle is, don't have anything in it that rouses suspicion. Leave the bud at home.
