I can't stress this enough, you need to have evidence to support the time you have seen him/her follow you, call you etc..
Get a notebook and write everything that has happened to you with the stalker along with dates and times. If you can't remember the dates from the past, narrow them down to the smallest time span you can. If you have everything written down as they happen, your evidence will have much more credibility if/when it goes to court.
2. Call the police to report it. Tell them you fear for your safety from this person (if you do) and show them the journal you have made. We have an anti-stalking law in Canada called "criminal harrassment that is designed for stalkers. If there is enough evidence the officers can charge the person. If they can't charge, ask the officers to contact and warn the stalker to leave you alone. Write down the incident/case number the officer gives you and the names and badge numbers of the officers that attended. Put this information in your notebook, along with any action the officers took. Keep track of all officers you deal with and give them the report numbers from previous visits.
3. Seek a peace bond/restraining order. In Canada you can go see a justice of the peace at the court house and ask for a peace bond against the person (if you know who it is). If charges are laid this will be automatically done for you (at least in Canada).
4. The police can give you information on safety planning, many domestic violence organizations provide 911 emergency cell phones for free if you can't afford one.
Blackberry type devices are best as they have GPS in them so that the location of the 911 call can be traced to a specific location.
Let your neighbours know about your situation and give them the information about the stalker so they can keep an eye out for him/her or his/her vehicle.

It's best to file a police report first, then go to your local prosecutors office and file a restraining order, bring any evidence of stalking with you if you have any. Such as letters, answering machine messages, etc. Don't go anywhere alone if you can help it, lock up and most of all don't confront them. It's not worth it.

If you have a stalker let the police know, that is your first step. Make sure you have no contact with that person at all...no calls, no smiles in passing....NOTHING.
