I don't know that I would sue them but I would bring it to there attention letting them know what happened I'm sure they would have comped your meal and probably offered another free visit just to correct the problem.

Lawsuits are done to try to restore things back to as normal as possible after an event that was clearly someone else's fault.

Did you need medical attention, lose work time, or somehow suffer a real loss that can be compensated for?

Probably not unless it turns out that it was somehow infected.

The proper thing to do in a situation like this (when there is no injury) is to bring it to the attention of the person in charge.

At an absolute minimum, you should not be charged for 'bad food'. A free replacement item is also very common. Many places will offer or provide you with a free meal. Sometimes the entire party eats free.

Above and beyond this is getting a little greedy.

Probably. You can sue for just about anything, it's a matter of whether you'll win or not. You'd most likely need to make a case for negligence on the part of the restaurant and prove that it was they're fault the bracelet was in the shake. I am not a lawyer.

See thats the problem with America right now. Every time something happens to somebody, that is not their own fault, the first words that comes out of their mouth is "I'm going to sue". Why do you think insurance is so high and unaffordable right now. Its because of people sueing each other over little stupid inconveniences. What you should do, or should have done, is act like an adult and just go on with your life. Your still breathing, the world is still spinning, and theirs much worse things happening to people right now then finding something in your food.

You could sue, but it would probably be thrown out of court. If you were not injured, just get your meal comp'ed by the manager and go on with your life. We have too many people suing each other for silly things.

Not a lawyer, but I play one in my mind.

I know I would raise hell and somebody would be paying for that dinner, and another on the next visit!

Report their *** to the Health Dept., most definitely! And never eat there again...
