The Vietnam conflict was not considered an official war. It was always considered a war so that veterans can recieve benefits. Vietnam conflict did not begin until the U.S. provoked a war by having a navy destroyer circling around the Gulf of Tonkin. The U.S. had military intelligence and advisors in the country as early as 1956, almost six years or more prior to our official entry. Vietnam was divided in two and the French was already engaged into a war with the NVA.

No, we did not declare war. We were pulled into the Viet Nam situation through SEATO (South East Asia Treaty Organization), which like NATO (North Atlantic Treaty Organization) operates under the auspices of the United Nations. As long as we are entangled in foreign alliances and a member of the United Nations, you will never see a Declaration of War originating in Congress. A Declaration of War is an act of a sovereign nation.
Incidentally, Representative Ron Paul from Texas (one of the very few in the Congress that I truly admire) introduced a resolution for a Declaration of War in Iraq. It is not that he wanted to go to war. He wanted to see if the other members of the House of Representatives would act on it. In true cowardly fashion, they refused to consider it. They allowed a president to send American troops into combat while they did nothing.

The Vietnam War was never really a war at all, we went in to aide South Vietnam. The U.S. never officially declared war on North Vietnam.

Terminologically speaking it was a conflict, but the people who served are still war hero's.
