My wife is Sick with Thyroid Cancer and no one is there to take care of her while surgery will be done so i need to be with her .... Can i do that while case is under process of American Immigration?

Is your wife the US citizen and you the beneficiary?

If so, it is not illegal to travel to the US even though you have a K-3 visa in process, and many have done so successfully. However, there is no guarantee that the CBP will allow you to enter the US, especially since by filing a K-3 you have shown immigrant intent.

You can increase your chances of being allowed to enter the US while a K-3 is pending by bringing with you strong evidence of ties to your home country to show that you have no intention of staying in the US and abandoning the K-3 and having a return ticket.

If you are living in America, but your wife is not in the country than you should have no trouble to visit her temporarily. However, Homeland Security does of the power to make up any rule or regulation they want to, and you won't know it till you break it.
I'm going through the K3 process outside of America, but Homeland Security is making it impossible with their latent laws.

Still if I were you I would go.

Check with them. Talk to someone whose handling your immigration. I hope she recovers. We've been going through cancer too here in Canada - my husband.
