my brother was deported 2yrs ago from the U.S. but his wife is filing some paperwork for him so he can get his greencard ....is it possible for him to get a greencard .....he had a warrant out on him, will that be a major factor in decidin if he does or doesn't get a greencard?

Ok

1. It depends on the bar that he has. Whether, 5 , 10 yr or in some cases a lifetime bar. You need to find that out first

2. He needs to file an application known as a waiver. (I-212). Permission to reapply for Admission to the United States After Deportation or Removal.

If this waiver is approved, then his wife can continue the usual filing (green card process).

Sure it is just watch CNN and checkout the story of that person wholed up in the church claiming that she has the right to stay because she had a child and he is a citizen. I am so sick of people comming here illegally and then trying to work the system it is unbelieveable! If he has a warrant there SHOULD be no way but what made since yesterday doens't seem to make since today........

You can file the proper paperwork to come back to the US. It depends on INS and what he was deported for. Also, with the warrant it just depends on what it was for. There us to be a fine and then had to remain out of the state of a certain amount of time.

He was deported for a reason and usually its not a good one, I don't think his wife could get anything done for at least 6-10 years. So, he needs to stay there and his wife should join him unless he has found himself another squeeze. Like I said, he got deported for a reason and only you guys know the reason, so do the math. By the way, if he does sneak back and gets caught, he will do an automatic 60 months (yes 60) and will serve the whole term, and then get re-deported.

There ain't no way in hell that he will be readmitted after being DEPORTED before. This country had dropped the ball on immigration, but I don' think it's that inept to allow re-entry to a deportee...or is it???

Yes it's possible but everyones situation is different. People with a criminal record, ongoing or not will effect getting their status in the U.S. depends on the crime.

Yes it is going to be very hard and it's going to take approximately 7-10 years and a-lot of cash. I don't know the details but I suggest you consult an attorney.

I hope not. But the answer is probably "yes". If he has a warrant awaiting him, does he really want back in?
