no restrainging order against me
no prior offenses
nothing..police said I didnt break any laws, ordinances, but some kids wanted to pick a fight with me eariler in the day near my ex's house, and my ex lives in that town and was complaining about me, so they forced me to leave the city and said i'd be arrested if I didnt..tho I hadnt done any wrong..they even admitted to that..they just wanted me gone...although I was staying at my aunts house in that town..but I guess that doesnt matter

I've read some of the comments given by others here and some of them have good points but haven't got it exactly right. Many times the D.A. will try to make it a part of someones probation. This is called "banishment" and is considered to be un-Constitutional. A lower court may uphold the decision to put such a judgment against you for several reasons. One: To go along with the D.A. on a plea-bargain, Two: To force a defendant to spend more appealing the decision, with the judge having knowledge that he has absolute immunity from being found liable for casting the judgment against someone. Three: Lower court judges are not as concerned with the Constitution or in some cases not as learned as some of the higher courts Judges. In essence, we in the U.S. have the best justice *MONEY CAN BUY*.... An average Joe goes to find justice......and that is what he finds. "JUST-US".
On the other hand........ laws have been passed recently in some states that give power to officials to force banishment on defendants. It is attached to laws pertaining to "gangland" violence. It is being enforced in several states to date.

If the police are doing this on their own, they are overstepping their authority and are guilty of a criminal act themselves.

If it happens to you without a court order to support the police in there actions, file a charge or complaint with the U.S. Department of Justice. They will then have the F.B.I. investigate the Police Dept. When the investigation starts, notify the local T.V reporters and/or investigative reporters about what is taking place. They love a good story!( It gives the police a chance to see how it feels to have it stuck up their own...) Good luck......

Well.....lets just say this. By the time you've somehow managed to run across them every day of your life...and mind you not by your OWN valition.....they can make you WANT to leave the city because you're tired of having contact with them every day. especially since YOU aren't initiating the self-contact.

But...have no fear. there is no discrimination here. because if you go to another city....the word is passed to the police there as well that you're in town. Now...cops hate having outside problem children breeze in and settle into their area. So keep that in mind when you haven't even unpacked those cardboard boxes in your new place and the cops have already had contact with you a few times.

Keep on movin' son. There's no place for you here in this town.

I live in Ventura County California. Did you ever hear of Rodney King? Well this is where the trial against the 15 cops that beat him up was held.
Our district attorney's office is full of liars and thieves of freedom. Some of their bad habits have rubbed off on some of the police. Yes they will force you to leave the city. They will force you to leave the county. They will make it part of your probation. Do yourself a favor and don't complain about it or you will not be on probation for some reason you will be in prison.
It is called abuse of power. America just threw out a bunch of scumbag politicians. We will be working our way to the local level soon.

no, only a judge has authority to deem you a criminal and then to direct you. the police enforce the law, they don't make it. that said, they have a lot of authority and power and not all of them use it legally. It may be wise to consider how best to deal with an officer if he/she has told you to "get out of town"

In the u.k you can be legally banned from entering a city, kind of like an injuction order but from a whole place. If you are banned and you enter, then you will be arrested.

If they are enforcing a law or an order of protection, yes they can.

i know several people who were released from jail on the condition that they leave the state and never return.

So, yes, police can force you to leave a city.

Not without a good reason. If you are not wanted, or are causing trouble, they would have no reason to evict you from the city.

no they cant make you leave but can give you a hard time. if they are doing either seek help from a lawyer and set suit against them..
