My fiance was interviewed and told her papers were in order but told that final approval was denied pending further investigation. The investigation is secret and what they are investigating and why will not be revealed. There is no time table, questions are denied or simply refused, and no information concerning the investigation is revealed. I have contacted others and have been told this is a standard practice but no one seems to know why, when it will end, what they are looking for, if anything, or if anything is being done.

It is not a "secret" investigation. It is just routine followup because, I am sure you realize, there is just so much fraud in every kind of visa process - especially when it can lead to US citizenship. Now, more than ever, it is not just a matter of fraud, but also of national security.

Hi Jerry ...Our K-1 was returned for further review as well. It has been 9 months now and still pending . We are waiting for the VSC to review our case. We had everything in order, however none of it was touched by the consular officer. I was present, but not allowed to go inside .Our documentation included evidence of our one year relationship, translations for all documents, he passed the physical, a clean police report and all other required documents were notorized and completed. We have had 2 congressman and one senator inquire. We were advised that our case is still pending but no time frame when it will be completed. I have been to Morocco 4 times in a year . I do know the CSC has closed K-1 cases that have been returned. The VSC seems to be handling them differently. I have heard that they seem to be more fair when it comes to K-1 returns. It can be a long wait . Hang in there . It is up to the service centers what will happen from here. If they reaffirm the petition, after a rebuttal,it will be sent back to the embassy, for possibly another interview. Good luck !

Each embassy has a visa fraud unit. In some places (like the Philippines) fraud is rampant and thus all applicants are closely scrutinized. The visa fraud units have experienced local investigators who conduct investigations in the field. If your fiance was truthful then she has nothing to fear. If she lied or is covering up something, like an unreported marriage (frequent in the Philippines where there is no legal divorce) it will be discovered during the investigation and your application will be rejected. The investigation can take up to six months.

What can trigger an investigation? Well, in my experience suspicious documents (there's a massive trade in forged documents in the Philippines) or medical evidence of a woman having given birth (found during the physical exam) when no children are listed in her bio data.

The bona fides of your fiance are being investigated. They may check to see if the details of her application corroborate with known information. Revealing information about an investigation would risk undermining this process, and statements may come from third parties who would wish to remain anonymous.

Trust me, in the long run you will be thankful if the embassy digs up something about your fiance that would be best known before you legally marry that person.
