I had a car repoed 6 years ago, and just last week i got a call from some realy rude man demanding 12k for the balance, intrest and fees. I told him i dont get it and i am not paying you and hung up the phone. Then my wife answed the phone and she told him i am not in, he told her that he need to get in contact with him in 24 hrs, If i dont get in touch with him he is going to falicate a law suit/and it could result in prison time.
I am really worried.

Looks like you may have an unethical CON after you. This persons company bought that balance for 200 bucks, now imagine if you had a pile of cash and coughed it up he would be 10k richer. Check the states Statue of Limitations, goggle-Statue of limitations on Debt. Then send this company a ceist and desist letter, that means after he gets that he can not call you. send it certified. If he gets in contact with you again then sue him. YOU CANNOT GET THROWN IN JAIL FOR THIS, THAT IS A TREAT AND AGAINST THE LAW. sorry for the shout! This repo will fall off of your credit in 1 year. But they will sell this balance to new agency's and do the same thing sending them that letter, don't pay them a dime

Ignore him. He is making threats that are illegal. Do not pay a dime!!!!! The repo will drop off on your credit report after 7 years, so do nothing. It you pay or even sign something, you may restart the collection process. The statute of limitations is usually 5 years, so he does not have a leg to stand on. You can not go to prison for this.

Just start screening your calls by using an answering machine, caller ID, and anonymous call blocking.

Collection agencies will try anything. You have a few options. Check out the link below. First of all, they can not threaten/harrass you. They can't put you in jail. They can take you to court, but they have to mean it when they say it. Also, I don't know what state you live in, in some states, 6 years is past the statute of limiations (the amount of time they have to sue you) has expired. Good luck and hope this helps. You cannot be arrested for not paying a debt. It may be possible for him to obtain a judgment against you for the balance of the debt. It depends on local laws. There are time limits as to when a lawsuit may be filed and proceedures a collector must use to collect a debt. If he threatened you with arrest and jail time, he could be in violation of the federal law. There are strict laws concerning what a collection agency can do to collect a debt. If the collector fails to file within the prescribed time, then they may be unable to collect or obtain a judgment against you. If I were you, I would get in touch with an attorney or one of the credit bureaus to see whether the law was violated and what you may need to do about it. You are not required to speak with them or call him back. You may want to send a certified letter return receipt requested and tell them that you want them to stop calling you and only communicate with you in writing.

I don't know about prison time, that seems to be far reaching. But it never pays to avoid these people, they have a job to do just like you do. He may have gotten terse with your wife, but you did hang up on him. Listen to what they say and if you cannot do what they want, find a financial advisor who will talk to them for you. He did not really expect you to come up with 12 k, that was his starting point.

Go to Federal Trade Commission with all of the information that you can collect about them. Give no information to any stranger. http://www.ftc.gov. You can also put all of his business in the streets at http://www.ripoffreport.com. This site will allow you to blow some steam off and warn other consumers about this troll. Good luck!

Make sure that you document all calls made like that. Keep them until that situation is not on your credit anymore. If it continues report it. That is harrasment.
