My friend is a police officer in a small town called Rocksprings Tx. In 2005 he tried to pull over a suspicious vehicle. It stopped and when he got out of his patrol car, it tried to run him over. He then shot at the tires blowing one of them which caused the vehicle to wreck. There were 7 illegal aliens in the van, non which were seriously hurt. 9 months later, he was arrested by federal marshalls and charged with a felony assualt charge and faces up to 20 years in jail. By the way, the wetbacks were freed and given green cards. What is wrong with this picture.

Based on what you're saying it sounds like your friend did nothing wrong, however, I would bet my hard earned money there is more to the story.

The first is his reason for stopping the car. Did he have probable cause to believe a traffic violation had been committed, or did he have reasonable suspicion to believe criminal activity was afoot?

The vehicle tried to run him over. Did he have another option other than deadly force, such as getting out of the way? This may have been more appropriate than shooting. Let's say he tried to stop the van for a burned out head light and the driver tries to run him over. He is absolutely justified in shooting that driver to stop the threat, but would it have been more reasonable to get out of the way and not endanger the "innocent" passengers in the vehicle?

Why did he shoot the tire? I could see the tire being shot out if he missed, but shooting a tire is not way to quickly stop a moving vehicle presenting a lethal threat. Why not shoot the driver?

I am not saying your friend was wrong at all. Based on the information you've given his actions sounded justified, however, without knowing all the facts it's impossible to make a reasonable conclusion.

There's a lot wrong with this picture as well as your use of the term wetbacks. If the cops's actions were investigated and he is sentenced then there is obviously something more to the story. I am concerned how the illegal immigrants suddenly received green cards. I don't know, this story doesn't sound right at all.

As a former Police Officer I would say he over reacted to the situation. One does not try and kill someone just because the vehicle tried to take off. ( All Officers always say the vehicle tried to run over them....It is a standard saying in the Police World ) You Police Officer friend is mostly a real nice man I'm sure but he made a mistake. He must now pay the price for over reacting.

Your police officer friend had no valid reason to pull over the van, the "wetbacks" were not felons, He used "excessive force" and he discharged a firearm without sufficient reason to do so.!

What is wrong with this picture is the fact that you need to open your mind up to the fact that your friend maybe was at fault.

because the government has its head up its butt. They believe that illegals have all the legal rights to sue and have anyone that does anything to them prosecuted.

I believe that as soon as they cross the border they become target practice
