if a guy raises his hand to a girl can that be considered assault?
(raising a hand - like raising your hand like you are going to slap someone but then dont)
please help
he did that to me and i grabbed his hair and threw him to the floor....ya i know that can be assault but can what he did to me be assault?

he also does things that might be assault all the time... i.e. he kicks me, trips me, and other annoying things...and yes i kow i assaulted him

Well according to what one of my friends went to jail for...

What he did could be considered "Attempted Assault"

And what you did was assault..

Although depending on your lawyer you could probably plead justifiable self defense or something.

Good for you!!! No, in the eyes of the law, him raising his hand is not considered assault. You can really just go on self defense. If someone holds a gun to your head it's not murder, but you were threatened and thus trying to protect yourself!!!

If he didn't actually touch you, it was not assault, but it was a threat. Could be construed as attempted assault, in which case you have the right to defend yourself, (sounds like you did a heck of a job at). Good to know you don't let any man try to hit you!!

Legally he did not assault you. You can't get in trouble , because he lifted his hand and you struck him in self defense. He did intimidate you which is a crime but not assault he needs to make contact. Even if it's just him spitting on you that is considered assault.

Hi yes i would also concider that a attempt of a assault.But by you putting ur hands on the other person you are the one who did the assault.Be very careful of gestures like that.Usually its a sign that the person will surly use and do that in a attempt to get what they want.Instead of talking and working out whatever problem it is.B careful B well

Yes if he intended to slap you I would consider that but on the other hand he never got the chance to do that as you grabbed his hair and threw him to the floor.So you beat him to the draw.Good for you. Hope you got rid of this loser.At least you are here to tell about it and not seeing your OBITS in the local news. You were just afraid and had to stand up for yourself.

To the best of my knowledge,it could be considered a "terroristic threat" if you felt you was in danger at that moment when he raised his hand at you.But not assault.

It may not technically be assault but is it aggressive and provocative behavior.

It sounds to me like the two of you are not good together. This is not a healthy situation.

What he did is considered "threatening to assault". It's almost just as bad, as it IS considered abuse, same as verbal. It's all abusive, and you can get a restraining order against him for any of those, But....I don't think you may need one, since you kicked his ***........good going!!

Technically, you assaulted him. But if a guy raises his hand at you, that means its building up. He won't do it now.....but somewhere down the line, something will set him off, and he'll do it. I suggest you keep your distance from this man.
