If a woman gives birth in the airplane (there was one that happened in Chicago recently.don't know how she got clearance to fly) coming from Mexico to Chicago, would that child be an immigrant or just a vistor?

I realized the question should have been citizen or visitor. The mother was a Mexican citizen visting relatives here in the U.S.

if it was a birth in American air space then the child is American.

That child would be a visitor because she is traveling legally, Unless she was moving to Chicago legally from Mexico, then the child would be considered a citizen. Same thing as if you were on a trip to europe and had the baby there, it would still be a U.S. resident and not a European resident.

I guess that depends, but since she is entering the United States then the baby would be a US citizen.

if the airplane was already in the USA he will be a citizen cuz if some one is born if the USA don't matter where he born in a airplane,boat,car, he will be automatically and American

was the women illegal or just visting mexico? More than likely since the child was born on American soil he or she would be a American.

If she gives birth in international air space or international waters, the child is only a citizen of the country of his/her parents.

They would have to be born on land. Just like a cuban must touch U.S. soil literally. Air doesnt count.

They may apply the 14th amendment and think of him as American because he was born in US airspace.But who knows?
When I was pregnant the doctor wouldn't let me fly from my 4th month on .I guess things have changed.Its not like she didn't know that the birth was eminent ,I feel it was planned.But again who really knows.I read that many wealthy Mexican woman are coming to the US to give birth .

the child is a mexican citizen, assuming the parents are
mexican....if the parents are american citizens then the child
is american.
