I have a 6 month old child with an illegal immigrant. I want to marry him and get him legalized in the United States, but I don't want him to have to leave and stay in Mexico while the process in going on. He is my source of income at the time and we wouldn't be able to make a good living in Mexico, that is why he left. He also has a 4 year old and 2 year old with another legal woman.
Please help I'm worried about him getting deported.

If you don't have anything nice to say then keep your opinions to yourself. I am appalled at what you would say about someone you don't even know. Especially calling my child a name. If you are going to say anything you need to leave my child out of it. By the way he does support his other children and the reason he isn't with the other woman is because she cheated on him with someone who can't even speak English when he can. He has a good job and owns his own business unlike some of the true Americans who have written bad things themselves. Don't critasize something you don't understand. You can't help who you fall in love with. For the people who helped me thank you.

The best thing that I can suggest is that you find yourself a reputable attorney. There are some that say they can help you - and they don't. They just take your money. At this point right now according to the immigration attorney that I have if he did not come here legally (i.e. on a visa, then overstayed the visa) then he has to go back to Mexico then you have to apply for a fiance visa. The way the law is right now it is you have to have had/have status to get status.
When you call a lawyer explain to them that he is an EWI (enter without inspection) and ask if the immigration laws have been updated regarding the EWI's.

right now if you file for the i-131 and 485a that process take roughly 1-2 years after that he will be asked to return to Juarez Mexico and then told to go back to his town in Mexico they are saying the wait for him in Mexico is 6months-1 year. You will have to get a job anyways if you are going to marry him and be his finically support on his papers. It is $18000.00 for 2 and 3,000 for each additional person in the house. Also you can do most of his paperwork on your own as long as he has no major felonies. Or call like a catholic char ties they can usually help you with filing the papers. After filing the papers and paying all the fines it runs about $3500.00 and if your get attorney you have to add his charges in also. This is a very long process. Sounds like you made some bad choices, and so did he. You said you don't want him to go back to Mexico, but if he gets caught here, he will not be able to return for 10 years, and he he does return in that time frame, you might as well say good bye to him for good.

Your best shot is to talk to a immigration lawyer.

But honestly, you really need to ask your self if this guy is worth it.. you mentioned he has young children with another woman... I would be questioning if this guy will remain faithfull, sounds like he lives for the moment, and might just bring you more problems in the future.

I have a foreign spouse myself, and we have three kids. I understand your concern, and I can empathize. However, your fiance is a criminal, and you don't want that haunting you.

Just make it right even if it means he has to go back for a while. Believe me I know how much suffering that is, but I swear to you in the long run you will be far better off.

he won't get deported if you apply for his naturalization through marriage. As long as he's divorsed with his previous wife and you are legally married. If you are a US citizen there will be no problem. Anothe issue if you're a Permanent Resident. This then will take longer.
If you;re US citizen your child will be a good advantage for him to get leagalized.

Please marry him and go live in Mexico. You won't have to stay long - he'll leave you and go have children with someone else. In fact, you don't even have to leave - just tell him you WANT to go live in Mexico - that sound you hear will be him running out the door. He's just looking for a US citizen gullible enough to get him a green card.

Good God lady grow up, send him back to Mexico and start the legalization there where your suppose to. In the mean time get off your azz, get off the computer, go get a job and quit expecting everyone else to support you

maybe he should think about being able to provide for his kids before he wantonly creates them? the creation of a child does not entitle him to citizenship and neither does marriage; the fact that he already has "legal" children would seem to indicate that he is breeding for citizenship and smacks of disgust. of course, he could be perfectly innocent of being conniving, but he is decidedly irresponsible and that doesn't make for an ideal citizen does it? It's too bad your child has a father who is not his/her countryman, but you made that choice when you lay with him. Now the child may well have to live without a father.

What is his profession? I'm sure he can find a nice job in Mexico, maybe you will not live as comfortable as here in the U.S. but you won't live out in the streets!

The legal way to go about marrying an illegal immigrant is to fill out all of the paperwork and then bring him into the country. Since he is already here, you will have to contact an immigration lawyer and see if they can help you.
