I recently got a speeding ticket in Knoxville, TN in a construction zone. The officer checked the workers present box, but there were none anywhere, I took pictures right after. I'm not sure the amount yet but if it's outrageous, which it probably will be, I want to challenge it. Does anybody know what my chances with this are, and if I can do any of this through the mail in TN? I live in Atlanta so it's not a convenient trip.

I got a ticket between Nashville and Knoxville about ten years ago in a construction zone, they were cutting down trees next to the road.

The officer said the ticket would have been $500.00 but he let me off with a $270.00 ticket.

Yes the speed limits of construction zones are valid when there is no visible construction. UNLESS, there is a posted sign stating "While workers are present" is there a difference. The judge might dismiss your ticket. Then again the judge might add to your ticket. In all honesty it sounds like you came across a cop in a good mood and you are lucky. You probably should have asked the officer though because the ticket was to his discretion. Cops don't do what ever they want they enforce the law they are not the law.

Look I have no idea of your driving record. Speeding in a construction zone is serious. What you should do is to find the best traffic attorney in Knoxville, Tennessee and get him to represent you. Sure it will cost you about $500, but these lawyers can sometimes get these things reduced and also the fines reduced. As bad as it sounds the judge in these type case always side with the law enforcement officer. Find a good traffic attorney in Knoxville and he should be able to help you with this.

Just pay the fine. You can take all the pictures you want but they mean ugatz in court. how do they know when you took them? Forget the old time/date stamp too. Those can easily be altered.
States don't take too kindly to people speeding in work zones. It doesn't matter if no one was there....the area was posted right? Do you think the court gives a goddamn if you run a stop sign because "there was no one coming in either direction"? Nope. They point out there is a reason for the law and it doesn't make for allowences in certain circumstances. pay the fine or be prepared to really get screwed to the wall when they tell you you've lost anyway.

Hi Sean,
Sorry to hear about your ticket. My mother received a ticket in Lebanon TN and we live in Knoxville; she wrote the judge a letter explaining the situation and how hard it would be for her to appear in court to contest the charges against her, and he dismissed the case immedietely. If you do have to appear in court, best of luck to you. Not only is KPD extremely corrupt and malicious, but the judges are bored and-non commital to the cases, and they rarely rule in favor of the defendant. Good job taking the pictures, definitely send those in with your letter. Best of luck!

You can only pay it though the mail, if you want to fight it, you have to appear in court.

What you really want to worry about is the points, you will get from 6 to 8 points off your license just for that one offense in TN.

So it gets you close to the 12 needed to suspend your license.
