My Dad went in for Gastric Bypass Surgery on the 13th of November. He had been running a fever for two full days. A fever in which would indicate to me; not having a degree in the medical field, that there was something wrong in his body. The doctors never put him on antibiotics. My Dad passed away that Friday, November 17th. His death certificate stated that he died from Sepsis ( a leak from the surgery performed on his stomach). Should I seek a lawyer? I don't know where to go from here, but I do feel that he could have been saved. The doctors never gave him antibiotics and they only ran a CT Scan the day of surgery and two hours prior to his death on Friday. I beleive that the leak should have been brought to their attention a lot sooner. Am I wrong in thinking that I need a lawyer to get this handled?

That's the risk you take when you get a dangerous, and often unnecessary surgery. I'm sorry, but I'm sure they told him what could happen.

When something like this happens we feel the doctors should have saved him. We feel they're like Gods in there and, why couldn't they save him, he was our dad.

I'm sorry to say it just doesn't work that way. Yes, he may have died of sepsis but, did they say how big. Was it something they should have seen. Of course on the day of surgery if he was running a fever they should never have operated on him, it should have been postponed until the temp went down, in this case it wouldn't have and they would have found it.

It's a mystery as to why they operated and he had fever. Of course had they known they shouldn't have. But they did, and he did. You can get an attorney and sue the doctors and the hospital, hope all the records show it all. It may make you feel better. If it all happen that way, they should have something to pay on it.

I think the lawyer can come later. You need to grieve first. Getting angry, while understandable, isn't always the best way, especially when you are not thinking straight and are not in possession of all the facts.
Surgery of this type is a big deal, and it's possible that your dad already had an infection beforehand.
I'm not excusing anyone but I think it is too early to point the finger of blame.

At least talk to a lawyer. You may not be able to do anything, but you can at least find out about it. Don't call a lawyer that advertises on tv. You want one that will be there to help you and tell you your best option.

lawyer time...many people had this procedure done, and lived to loose 100 lbs or more...there should not have been any leaks of any kind!! i think it is jacoby & myers time....
