I live in Newport News, VA. I got a notice last week about us violating city code whatever for putting our trash cans out before 3pm the day prior to trash collection. Okay, guilty.....

This week, we purposely put our leaf bags in our yard and not on the curb until it was time. I got another notice, stating that we had violated that code again, and that they would ticket us. I called and the person who answered said that it just looked bad to have leaf bags in your front yard. We do not live in a homeowner's assocation, so I'm thinking they can't say anything about my leaf bags being in MY YARD. They were'nt on the city curb. Does anyone know???? I'm pissed!

The Code violation is dependent upon the city or county ordinance. For example in my city we have the ordinance which states no unsightly nuisance which will detract from the overall appearance of the street, alley or access way. Simply put it based upon the opinion of the Code enforcement officer.

Before I forget yes they can tell you what to do in your own yard. It is being done all over America. But that is for some other time.

My suggestion is to fight the citation. Get a copy of the ordinance. The Municipal court should be able to direct you to proper ordinance. Secondly contact your Mayor, and your City Councilman and file a complaint regarding the strict interpretation of the ordinance. And if you are really angry hire a lawyer to first win the case and secondly to see if there is some way to civilly handle the situation. You will have to sue the City if you want a civil remedy.

Who sits around thinking these things up I wonder ,we should fight for are rights.

there may be a city ordinance under "blight control". I'm willing to bet that's what you'll find out. If there is an ordinance...then you must comply.

I could tell you.... but it does look "trashy" no pun intended. Keep the bags in the backyard till pickup day.

they can do what ever they want, but you can try to fight it is the Law does not clearly state that you cannot have bags in your yard.
