Depending on the size of the tree, raise the level by putting it on top of something (like a small table) I doubt the dog would be able to lift his leg that high!

If this isn't an option, keep the dog out of the room where the tree is when you are out. Another thing I have seen on tv (although it hardly seems worth it over a christmas tree - it's not up for very long) is a pressure pad mat, you'd put it under the tree, if the dog steps on it, it emits an alarm - the dog then backs off because it doesn't like the sound. (these can also be used in situations where dogs rifle through the kitchen bin, raid the fridge etc)

Until you put the tree away, crate him when you are not home since he does it when you are not there and you can't correct him at the time he does it.
Otherwise you could try and show him the area where there is some pee and tell him "NO", take him outside right away and tell him "Go Potty" or "Take a Break" or whatever you tell him. Praise him when he goes outside.
My first option would be the crate though. For two reasons. A friend of mine's dog ate a wrapped present that was hazardous and also expensive!

Your dog is marking that tree as part of his territory. He doesn't do it when you are home because you would be a witness to his crime! He's a clever dog. There is nothing short of setting the tree on something higher, which he may pee on also, or giving up the tree. Your dog resents the intrusion and he 'captures' it for his own. (Next time get a female dog)

Is your dog crate trained? If he is, leave him in the crate when you're not home so he can't get anywhere near the tree. You could also set up a baby gate to make the room with the tree in it inaccessible to him when you're not home. Baby gates are pretty inexpensive. If you have never been able to catch him in the act, this might be the best you can do.

There are lots of different products on the market to repell animals. Some using pheremones, some just have a nasty smell, there are area rugs that emit a static shock (similar to scuffing your feet across the carpet then touching something) that will keep animals away. Go to your local pet store and ask the salesperson to reccomend a product.

He is showing you how much he regards your ignoring him. To pen a dog up and make it live to your schedule and get your affection only when it is suitable, then what is cruelity to animals. Dogs act out when treated this way. Ask an expert how you can take back control short of peeing on the dog.

Whoever said shoot the dog should be shot themselves. ANIMAL HATER. Okay. I own three dogs myself. I love them to death. the first year they saw a Christmas tree they immediately wanted to do their business. I suggest watching the dog around the tree for a few times, Don't make it obvious you are watching then when you catch him/her rub their nose in it and put them outside. do this a couple of times and it should work. good luck.

Keep him away from the tree when you are not home . He thinks you've brought him in his own personal peeing-post.

If he is only doing this when you are not home either crate him or lock him in another room away from the tree while you are gone. You could also try a belly band I have heard those work well.
