I have three uncles, two of whom do not like the other, perhaps because he is more successful and they want him not to receive inheritance from gramps who died earlier in year. In order to get rid of him, they plan to have him killed at my other uncle's house. One night, said uncle and cousin were hanging around at uncle's house. Cousin was trying to get him to give him a ride to other uncle's house, where he would later be shot. It didn't go well because uncle was not willing to give ride, so cousin gets angry, storms outside, and shoots two bullets at windshield @ point blank range. He then leaves driveway, where uncle's girlfriend's ex-husband is waiting, and leaves. Uncle then calls police to make report and catch guy who just shot his car. Police catch cousin with 44 mag and bag of weed in getaway car, who claims he had to leave 'cuz uncle was shooting. He is then arrested and released on plea bargain, pleading guilty to shooting at uncle's house (no bullet holes were later found)

Meanwhile, other police soon arrive @ uncle's house, saying they were called in because cousin claimed he was shot at & in danger of life, which was TOTAL BS 'cuz he was the one w/ gun! Police then arrest uncle without being made aware of the charges or reading him his rights. As soon as he arrives at jail, he demands attorney and records the conv. w/ police, who still do not inform him of rights. He is never granted attorney or phone call. After five days of incarceration, he still does not receive paperwork or police report. He returns few days later, and is told BS that report is still in litigation. Not sure if he ever got police report. Was arrest/incarceration legal? Some elements obviously are, so with what crimes could he charge police? I know there was conspiracy to commit murder, but should I hire private investigator to help prove this? Would this also make a good civil case?

My uncle was the one framed by his two brothers (my other uncles) and his cousin, who I think is my fourth cousin. They only framed him because the plan for murder did not go as planned, so they had to do something to put him away so he could have no input in pending estate matters. It is suspected that police are involved, too.

It was the cousin who alleged that my uncle fired from the porch at my uncle's own car while the cousin was driving it away, which would have been impossible because the bulletholes were at point blank range.

OK I'm not sure who was framed? They couldn't arrest your uncle if said cousin shot his own vehicle with the gun he was carrying, Sounds like an ex-husband in the deal too? Your uncle needs to press charges against the nephew and get an order of protection, that way if anything happens to uncle he will be the first one picked up by police and when facing murder will probably sing like a bird, involvement of girlfriend's ex will point the finger of suspicion at him too. Making sure the whole thing is on report with the police/D.A.'s office is the best life insurance he can have. Your uncle also needs to hire a REAL GOOD private investigator, posthumously" in his will, so if anything happens an investigation will be relentlessly pursued even if the police write it off as natural causes/accident.

Talk about dysfunctional families! I think I saw this one in an old episode of Barnaby Jones. It was twisty though, and the supposedly good uncle was pulling every ones strings. The solution is to get everyone together on the Jerry Springer show. This thing needs some air, or airtime, or whatever.
