quick enough to a spouse's abuse of a child.

The spouse is charged with capital murder.

This is in Texas.

It's not like he stood by while she beat the child. He was at work when the fatal injuries occured & took the boy to the hospital the moment he got home.

I think the arguement would be "You knew what she was capable of & didn't stop her."

What would be the range? Least amount of jail-time vs. the max jail time for 'Injury to a Child."

Who is defending anyone?

I'm just stating the facts of the case as to how they may affect the sentence he may get!


BTW - It is disputed as to whether any abuse took place or whether it was an accident. I will neither convict or exonerate wither of them until all the facts are out!

Injury to a child in the state of texas is several different charges all of them felonies on different levels if it is the lowest or a "state jail felony" then the maximum sentence would be two years in a state jail facility and a fine of up to ten thousand dollars plus court costs

Will really only the juge can look at this just because you say he new what she could do does not hold water with me an i would say with the juge it has to be proven in court, i would say since he took the child to the er he did the right thing so i say no jail time

I think of instead of defending him you should ask why he didn't say anything when he saw the bruises on the child. It didn't just start that one day and ended. It probly was a daily thing and he either didn't want to do anything and be in denile or he didnt care. I think he should get the max sentence there is. The children are defensless and when it comes to that type of thing they shouldnt pull any punches. If you dont like this answer or any like it dont post questions such as this. Sounds like you should be questioned to or have your children looked at to make sure they are ok if you dont think that he did anything wrong.
