I was recently pulled over by a police officer after leaving a whataburger that was a little over a 1000 feet from a drug free zone. I had marijuana in my car, but i was pulled over for a expired sticker after I left and had travelled even further from the zone. i was arrested, and charged with possesion in a drug free zone. does the drug free zone count even though I was not in it when I was arrested. I was not near any churches, schools, arcades or anything. i was pulled over next to a abandoned house, self storage and a farmers field and two residences. please help me.

The actual location that you were arrested does not matter. As long as the police report states that you were within 1000 feet prior to your arrest, you were in that zone and in possession of marijuana.
If you apply common sense as a reference, the marijuana didn't jump into the car after you left that parking lot.

OK sorry to tell you but yes it can count. The reasoning being is you were in a drug free zone. If the cop can attest to this in court it can count. And yep get a good lawyer, he may very well be able to help. And this is going to depend on how much of a record you have. Good Luck.

If the officer saw your vehicle in the 1000 feet and then found the mari even out of the zone, yes, you can and will be charged with having it in the zone.
Texas is picky that way.

Mistake # 1 : You had Marijuana IN YOUR POSESSION.
Mistake # 2 : Your sticker was EXPIRED giving him CAUSE to pull you over.
WHERE you were arrested has no bearing. The fact that YOU were in posession of a Controlled Dangerous Substance WHILE YOU WERE IN A DRUG FREE ZONE is ALL that matters.
You brought it on yourself.
Good luck, and wise up, or your life will be a living hell.
