Usually the mother must prove the mother unfit. Why don't you just file for shared parenting or joint custody. Unless the mother truly is unfit. Good luck and God bless****

Sorry ... but it's really hard to take a child from it's mother... my husband found this out the hard way and $1000.00's of $$$.
First she has to have a record of charges or something to base that you are the better parent. If her record is clean you might as well save your money. Solid proof is what you need and there has to be a pattern of what she is doing wrong with/0to the child.
Your income or home being better won't help. The courts will just make you pay the mother more to bring her style of living up to the standard of living you have. So my point she has to be really bad and everything documented. I know this from experience. My husbands ex abandoned her children for five years. One day she decided she wanted the kids... the judge gave them to her because he said it was time she had a chance to be a mother. During the five years she was gone...they stayed married and she lived with another man. You would think that would have been good enough to deny her custody... Good luck and I wish I had better advice.

Unless she is truly an unfit parent,, If you make that statement you will have to prove that Throwing out an accusation without proof will make you look vindictive and not a good choice as principal care giver. The best way is to come to an agreement with her before the lawyers get ah old of it.. You will loose less in the long run.. Trust me I went through it .My son pleaded with the judge to stay with me and I still lost . The odds are staked against us men its sad to say but you will fight an uphill battle and your outnumbers 1 to 10.

None. Unless the mother is totally unfit, such as drug addiction,
proven prostitution,abusive to the children, neglectful or has
abandoned the children, u don't have a chance. My advise to u
is to have as much interaction with ur children and be civilized
to their mother......and if ur lucky the children will choose u when
they get older.....be patient and good luck.

why is it that fathers want to steal kids from their mommies when their marriages break up? get over the fact you are now divorced - you chose to be, just like you chose to marry. if spouses - male and female - remember the simple fact that at one point they loved each other enough to marry and make babies, regardless how much they despise each other now, they should respect that fact if none other, and make life pleasant for the sake of the kids instead of trying to be the "winner'. there is no winner in divorce, only losers, and the way you handle life after that shows your maturity as a responsible parent and role model to your children.

Bill, I'm struggling with that myself and the only answer I came up with is to pay high profile attorneys not jokers that has no respect in court. $5000.00 just to get started this doesn't include court but Judges really respect lawyers that fight for their clients. Trust me don't go in their along you can get raped don't do it even if you have to save.
