As long as their children they shouldn't. We as parents have to do whats best for our children lives, even if that means they can't see mommy or daddy everyday. They will soon understand your reason and appreciate what you've done.
But by law, I think its 14 or 15.

What a tough one. I remember as a 9 year old, I knew exactly which parent I was happiest living with.
When a seperation is unpleasant, children can be surprisingly wise when it comes to telling which parent they are happiest with and want to live with.
The trouble is, the law does not always take into account what the child actually wishes because it is not always possible to tell if the child is being genuine or has been coached.
At 9 years old I wrote a letter to the the court describing what I felt.
I hope the best happens here.

At the age of 16 you can get legal rights to be your own guardian and get rid of ur mother, for good, but that's a really permanate solution, you could just talk w/ ur mom, and if your mom disagrees, have your dad talk to her, but legally i think it's 16, plus then if you have a car just go for it and drive... i'm 14 and i choose where I live cuz I am a very defiant person, you can just do what you want, and leave but that can cause some problems but i think legally ifyou go to court it's 12 or 13

In the Uk the law says that a child is able at any age to make up their own mind if they are seen as Gilleck Competent . It was a case that set precedent look it up and research this as youre child is most certainly should be classed as Gilleck Competent

The best idea would be to share. i know its easier said than done but the child should grow up in an environment where they see both parents and grow up in a place where there is love. but you dont have to show love to your partner but atleast for the child sake show a bit of affection. However until the child is able to understand for her/his self do not show hetred, it is the ones that see hatred that end up torturing animals at a small age and then end up on the street feeding and addiction that they never wanted. i am a training psychologist in my final year i should know!! please take my advice it will most surely help thats if you want it!!

I think it depends on the state you live in the maturity of the child, but I think it is 12 or 14 years old

Depending on how vicious your ex wants to get. They can always take you to court and have you deemed not the best alternative for residential placement at your home just by requesting a home evaluation done. Of course that one is a two way street. Good luck.

i think but not 100% sure that a court will take the childs wish into thought at the age of 10 (this happened with a friend of mine) but it may have changed, if its not a court issue then i guess any age but both parents my have to agree

Unless shes a very mature 12 shes prolly a little young to be making that choice just yet. shes also at an age where she'll be needing her mum close more than ever soon..puberty! give her time.
