My wife who is Permanent Resident, has filed a I-30 Petition and I have a courrent 5 yearTourist Visa, since I am physically in the States, with our three american citizen children. My concern is since the process could take more than 5 years, could I stay in the United States waiting for the decision or instead I should go to my country to wait for the residence???

Since your wife is only a Permanent Resident, then yes, it may very well take up to 5 years for you to be approved.

However, overstaying your visitor visa will only cause complications with your I-130 and possibly delay or even cause for a denial. Don't overstay your visitor visa, go back to your country before your I-94 expires and just continue to use the visitor visa to make regular visits to the US to see your family while waiting for the I-130 to be processed.

You may have a five year tourist visa but your stay depends on the white I94 stamp they gave you to enter, there is a departure stamp on it and you have to turn that in before it expires and get a new one when you reenter.
Getting your residency will not take five years but if you don't follow the rules it will be a long and lengthy process and they can deny you.

What kind of 5 year tourist visa do you have? I've never heard of that. And the process won't take longer than five years - after the interview, you will receive conditional residency, that should only take a year or two to complete.

It doesn't take 5 years to get your residency......Have your wife sponsor you.....My hubby got his residency with a tourist visa, it took him 2 years to get resident status.....Contact an immigration attorney, it will be money well spent....

Go home. Follow the rules, and God Bless. But remember this, when you become a US citizen, please refer to the USA as 'your country'. If you overstay your visa, it will be harder for you to get residency.

Why not stay here.. the stupid Americans will pay any and all of your medical bills.. they will send you to school free and even get you welfare payments and food stamps.. If I were you.. I would stay
