My friend is up in court next week, i am scared for her? she commited a common assault on a stranger?
the details are that she did wrong, she has previous for supply possession of class b drugs and was on police bail for assaulting a police person at time of arrest. i love her but the magistrates said she may go to jail. Please only answer if you know about law or don't want to give me grief because i know and like a criminal.??

The truth is it comes down to what the judge thinks there is a chance your friend will get off I've seen worse crimes get of in court
i do feel for you and your friend it is not nice knowing you may go down

You need to get her an urgent psychiatric assessment as the best way to avoid a custodial may to be to get into treatment for whatever is causing the behaviour. She may be able to claim she has paranoia as a side effect of taking the drugs. Lets be honest she must have some sort of problem to behave in this way - the only problem is if it turns out to be personality disorder rather than mental illness. PD is untreatable in the traditional sense - albeit that using Cognitive Behavioural Therapies and other therapies people can learn to deal with it - the down-side of this is that the magistrates may think she would be more likely to access this inside.

It is the assault on a Police person that is likely to sink her, and the second victim being a stranger too, but if she can prove that she was mentally ill when she attacked both people she may have a chance of getting off. The nature of the drugs may contribute too. If they are such that they can induce paranoia - she may be shown to have had drug induced paranoia and if she gets therapy for the drug use to avoid the paranoia she may in with a chance.

People on remand facing a life-sentence often try the psychiatric route to avoid life-sentences of the three strikes and you are out kind. It can help when you are on bail.

What is worrying is that this is two assault charges - just hope that she has no previous on this, and that she gets no further charges because things could go rather badly for her.

At the end of the day she may go to prison but if you do everything you can for her then there really is no reason to worry because it serves no purpose. If the worst does come to the worst she won't serve the full sentence anyway and may be able to qualify for a home detention curfew - but this does depend on the nature of her offence and her behaviour inside.

At the end of the day - don't let her drink excessively or take drugs if you can help it between now and the case because she needs to present herself in her best light. Just let her know that you are there for her. Criminals are only people and they virtually all have people who care for them she will need you even more if she does go down - visits, cards and letters are very important to people when they are incarcerated. If you can give her a land line number to call her phone credits will go further. She will also appreciate postal orders with a few pounds on occassions.

I nurse people with alchohol and drug problems who come into contact with the Criminal Justice System,so this information is based on what my patients tell me. Sorry there are so many maybes but things don't always go the way you are expecting them to go Magistrates are quite literally a law unto themselves.

She also needs to look at making some sincere apologies to her victims and to getting some very good legal advice.

erm unfortuanatly she probably will go down they prob wont bring her last conviction up as they not supposed to do that as she has been convicted of that offense and had/ serving her punishment, however im not to sure on that so dont quote me on it.

It also depends on what the evidence is like against her and if the other person has good evidence such as marks, bruising, witnesses, CCTV etc. I hope it all goes well for her and i hope she has a good solicitor/lawyer because i have a feeling shes going to need it.

Previous will be looked at! And seeing as there was an assault then, might not help her. She needs to get a good barrister and find justifiable grounds for the assault.

Fraid she could get locked up yes for assault (as she has a prev record that will come into account) depends on how good her solicitor is and also what judge she gets and also obv the case against her

in a magistrates court she may get six months, or it may go to the crown in which case she may get longer. i hope your friend gets bail hun.

no she wont go down, if some one can get 2 years for murder then she wont go down. but she should she comitted a crime and should be punshied. but this is the uk and its to soft she will probably get an asbo like all the other chavs. send her down i say

Possibility she will go to prison.With a good Lawyer she could get a susppended sentence.

i am training in police law and yes she will go down unless she has a very good lawer and good reason. 3 years min. sorry mate but shes going down.
