I live in Florida and am looking into moving to georgia, My ex is trying to make it leaglly impossible for me to leave. I thought the age was 12, does anyone know for sure??

Just because the child chooses a particular parent does not mean the courts will grant that parent sole custody. The court will take into consideration what is BEST for the child than what the child wants. Also if your husband has it put into the divorce decree that she can't be taken out of state it doesn't matter what age she is (until she reaches adulthood) you will HAVE to comply with that order. If you don't comply he can have you arrested/charged and convicted on kidnapping charges.

There is no for sure age. In NYS it is supposed to be 14, but my ex pushed to get our 13 year old's opinion used and he won. After leaning on him for 5 years or so (kid didn't have a chance, I'm afraid).

The reason for the move would be important. If you can't support yourself because there aren't decent jobs locally, then he probably can't stop you, but you may still have to go to court. He can lean on the kids to want to live with him, though, which means if you leave you'll wind up leaving them (or some of them?) behind.

12 sounds young, though. But check with your local family court.

When I was 8 and my parents divorced, I was able to decide which parent I wanted to live with. The judge asked me where I wanted to live and I choose. That was in Missouri and in 1989.
I would inquire about it with your attorney or look it up on line, like at the Florida state website and do a search.

I think the correct answer to that question should be when the child turns either twelve or thirteen but its not good to try to make them choose let the child choose on his or her own, Believe me I was in the same position before and its not a good feeling..

I think it is 13. At least it was when I went thru my child custody battles during my divorce. Ain't it hell?

you are right it is 12. and it might be hard to let go but sometimes you have to. your kid will always love you and come back.
