We moved to Spain in 2003 and now I have to return to the UK due to us splitting up. My husband told me today that he did not pay off his credit card bill or loan (both in joint names) Will this effect me getting a mortgage back in the UK. We have had a mortgage in Spain for 3 and half years and a credit card, can this go in my favour or do UK lenders not check foreign accounts and will I have a CCJ even though we'd left the Country.

If the credit card was in your joint names then the CCJ if registered will be in both names.

Basically if you have a credit commitment such as a credit card or loan and don't make any payments, for example when you left the country, the company would have writen to you or your husband at your last known address. If they received no response and no payments they would have sent a default letter out. If this was ignored, then they would probably have passed the account to a debt collection agency who presumably would have tried to make contact. Given that they would not have had any luck they would have passed the debt back to the original company who would then have applied to the court to register a CCJ against you.

However, you can write to the credit reference agencies and apply to put a note in the personal information section where you can explain that you moved abroad and your husband did not tell you that the debt hadn't been repaid. Whilst this won't make your credit rating improve, the note can be seen by potential lenders when deciding whether to give you further credit such as a mortgage. Check our www.experian.co.uk and www.equifax.co.uk for the details of who to contact to add a note to your credit file.

It would also be worth obtaining a copy of your own credit file to see exactly what is showing on your credit file and whether your husband is telling the truth or just trying to scare you!

Lenders in the UK won't check a foreign mortgage as they do not have the ability to do so. Each country uses it's own system for recording an individual's credit file, however, if you can get copies of your mortgage statement they may take a view on your application.

However, you needn't despair as there are many lenders out there that will lend to you even if you have a CCJ or defaults on your credit file. You can not access them direct and will need to find a good independent mortgage broker to assist you as these products are only available through an intermediary. Although these non-conforming lenders used to charge extortionate rates, they have in recent years come down considerably in pricing and even with a bad credit file, you can now get a mortgage at rates that are only slightly above those of high street lenders.
