I suggest you go read something anything. Show me where it is against the law to secede then or now! That is why there were no charges ever filed! I am with the other answerer ask your teacher about changing the trail to Sherman or Lincoln. I'll burn your ears off!!! God Bless You and Our Southern People.

You loose the trial.
Treason : he resigned before taking a appointment to the Confederate state but maybe you could win this (thought I don't think so).

crimes against humanity : never heard of any crime that occured by troops under his command. You would loose this point.

Insiting insurrection : he did not take any action in the "rebellion" and joined only later the confederate state army after that the fighting had already started. Again you can not win this point.

In worst case for Lee, you could only give him a fine. ;-) Your case would be build on quicksand.

I suggest Lee get another public defendant.

How about a trial for Sherman, he burned the capitol of Georgia to the ground. Lee fought the war honorably, and he forced the surrender of the confederacy early. His involvement in the war was a matter of honor and protection of his neighbors. He had personally served in the army in the past and even helped put down a rebellion at a ferry.
