Do you think it's fair for a woman to take half of the dad's paycheck for childsupport? He isn't a deadbeat dad. He doesn't owe back support or anything like that. Her and her husband both have great jobs. But with all the money they take out of the father's check he can't afford to pay his rent or he can't even pay for food. She is planning on taking him back to court for even more money. Do you think this is fair?

btw, even with all the child support, she still makes him pay for medicine, clothes, babysitting, school supplies, and any school activies. He wants to lower it so we can have money for food other than macaroni and cheese, and spaghetti and meatballs. But we don't have money for a lawyer. Oh, when he can't afford to pay for something like a new basketball jersey she tries to get the money from me. I'm just the gf.

The child support is ordered (she had a good lawyer he didn't have one). But as to the paying everything else he does it to get her off his back. ex. If she wants money for one reason or another she'll call 50 times (no exag.) in an hour cussing him out and calling him a loser and such. If you don't answer the phone she'll go to my phone and call and call and call etc. If she still doesn't get anybody she'll wait until it's bedtime when we're sleeping and keep calling and such. If he's at work she'll call there too. So he pays it just to get her off his back. Btw, if he doesn't have the money to pay she'll ask the son to ask why he didn't pay. "Daddy, why didn't you pay mommy, she needs the money real bad!" She harrassed him for "medicine" money a couple weeks ago nonstop, come to find out she just wanted spending money for her trip to Jamaica with her husband.

This situation sounds sick.
First off, using a child for leverage on child support should be considered a reason to rearrange custody. At this point, you're not thinking of the child as a child, you're thinking of them as a paycheck (and somebody on a child support list claimed that this rarely happens).
I'd file those custody forms immediately and when the court date comes around, ask the judge to suspend a ruling until the custody is determined.
As far as the ex calling all the time, maybe you need a TRO or a PRO barring them from calling you. Get recordings and document.

Is it court ordered support? If it is, then he has to pay it.
But why is he paying for everything else? He shouldn't be doing that unless it's court ordered. He's giving her the support money and he shouldn't be forced to pay anything beyond that.
You really need a lawyer on this. Since she's remarried and they both have good jobs, he might be able to get the amount he pays lowered a little if he takes her to court.
If she's taking him back to court, have him take in his financial statements and show the court that he's barely making ends meet. That can get complicated which is why he needs a lawyer. Have you tried the legal aid in your area? They offer free lawyers and or advise.

No it isn't fair to you. I feel this is an act of injustice to you and even your child. There is something you can do though. Make phone calls to attorneys that do probonos (work for free) on your behalf. They are out there but you have to put some time into it. It would be worth it to get the desired results. Take Care.

Definitely not, especially if she is remarried and has primary custody of the child. I don't see how it is fair that some dads don't ever get to see their kids but still have to pay an arm and a leg...

It isn't fair at all.
Its also not fair when your mom takes you away from your dad so she can have child support to use for vodka, whiskey, cigarettes, and wine. So it could be possible she is using her kids for child support so she can use it on everything but the kids. I would watch for that and use it for defense in court if that is true. just something to look out for.

No...I don't think it's fair. My mom raised four children on her own. Yeah, My dad did and continues to do his best...but he has to be able to support himself as well. My Mother busts her @ss providing for us, but she can get up in the morning and know that we survive and thrive by her hands (her words not mine) I think that women need to stop making the men pay for everything.
It takes two to tango...
