As a previous person has asked - how do they know that they are here illegally?? I don't know if it varies from state to state, but I know at least here in MD that if someone is put in jail, their immigration status is supposed to be checked, and if it is found that they are here illegally then the INS is called.
the problem though becomes that if people are stopped by police, and detained to do a background check on, and there is no way of knowing if a person is illegal until you stop them and check with INS, the police then begin to profile, and that is illegal as well.

Absolutely, we are a country of laws. Every sovereign nation has a right to protect the integrity of it's borders. Those who enter any country without meeting proper visa/ entry requirements, are by definition, criminals. Having said that, we are also a compassionate nation and already offer due process of law to those who land here illegally. We do more, have done more, for foreign people than any other nation. Statistically, more people immigrate to the U.S than any other country. Be American, be proud.

I agree that not all immigrants are good, but trying to run a backround check would eventually lead to discrimination becaouse the basis for who is a immigrant is very simple. Is he brown. I guarantee that no blond blue eye person would get a backround check. After all the US has had a record of racism. I.e the years of slavery.

Yes, it is called probable cause. Definitely, if it known they are illegal. Being here illegally here is a crime. Letting them loose is wrong. They have no reason to show up to court and lots not to.

Yes, but then they'd end up keeping all of them in jail, just being in this country illegal, is illegal, for most of them you can add on, using fake or stolen IDs, using fake or stolen SS cards.

Yes, illegal aliens are repeat offenders. 30% of all Federal Prison inmates are illegal aliens!

Your question doesn't make sense, if they are already in jail they are already being detained. If they have broken the law a court date will be set. I don't understand what you are asking, are you asking if they should be arrested and detained until the status of citizenship is proved or disproved? How would one know who is illegal and who isn't?

how do they know if you're illegal? you can't go by skin color. lots of aussies and canadians come here and work illegally, and as we all know, those countries have only white people.
