you cannot change the past. Hopefully your and your brothers futures will be brighter. Sometimes its better to let sleeping dogs be. Sounds like the judge was on the other guys side as well.
State police should have done the investigation. Understand that police protect their own as well.

Easy to say but hard to do. Don't look to enrich the governments pockets over this by looking to put the hurt on the guy that caused the problem. Just get some shyster lawyer and go after the guy's insurance company. Don't worry about how any police report reads unless the cop was there when the crash happened.

It will depend on the state and how their law enforcement is arranged,

Normally in most states, the department who is dispatched to the scene are the ones who work it.

in the city limits it would almsot always be the city police

on county roads, it is the sheriff or county police unit

on interstate and some state roads it would be either the county police or the sheriff office.

If an officer does a poor job, a complaint can be filed against him at this department

take that story to your local news station, and to state police, and demand a new investagation. complain to the news and state about corruption in local police department. bound to be others that know what really happened. search and you maybe able to prove when and where he was drinking.
