Make sure you let him know each time he steps out of line its unacceptable. My daughter tried this behavior and she didn't like standing in the bathroom brushing her teeth with soap.

5 year old are hard because they pick up everything and are trying to find how far they can push now, especially since we go to school. You can sit down with your step daughter and her parent and discuss a plan on how to make this better. What words are right to say and what are not. Make the rules of the house and have them both follow them. Remind him who signed his birth certificate and that he can be put into time out and put him there. Keep on him and stay consistant. Time outs in his bedroom with NO TV, no games , no toys . . . Explain why you and your son will not be smart mouth people then have him take the time outs and think about it (at least 1/2 hr with increasing time if it continues, just like real life, each time you commit a crime, your sentence increases !)
And your husband should have a serious game plan for correcting the step daughter, but regardless, you and your son will not be nasty people.

my 6 year old sister is the same way and shes been like that for a year now punish him every time he gets smart with you or anyone else my step mom and dad do nothing to my step sister because shes a "baby" and her mouth is getting alot worse.

I have a cousin 5 year old name Mackenize and she is thinks she knows everything so everytimes she has a smart mousth around us we make her pay 1 cent and ever since that she has been i good little girl and there is only 6 cents in that jar becasue she is sooo good. Maybe that will work with your little one too!!

You need to discipline the step daughter in front of your son. Teach him that there a consequences for his behaviour and her's as well. Remove his favourite toy from him every time he offends you. Time outs help.

timeout works wonderful, make sure you explain to him why he is being put in it though also explain that that kind of behavior is not tolerated and you need to check your step daughter about her behavior as well
