First of all you need to find out why she does not want a claim to be file with the insurance. Something must be going on... make sure that she owns the car and she's a legal driver. "YOU HAVE TO GET AT LEAST LIABILITY INSURANCE". That will at least prevent for you not to get in trouble with the police. No do not get a rental car... she did not want for the insurance company to be involved. Let her know that if she would have involved the insurance company she would have a rental car.

Your husband is at fault, you Both Are. You know better then to drive the car without insurance. But, on the other hand, the person that your husband hit, "didn't want to report it", something is UP! I hope you got her Driver's Licence numbers, address,etc. Are you sure she was legal to drive? It is just very strange to me that if she has Insurance, why she wouldn't want to report it. I believe you have done enough, check with the Insurance Bureau and find out how many days you have to report an accident. I believe it is 3-days, whatever the amount is, if it has been longer than that, I would tell her Insurance Company, due to the repair work your doing (no one needs to know why), and they tell her you will reimburse a percentage of the costs. I have a auto rental buisness, and see situations like this often. You said it wasnt his fault. If that is true then why did you agree to pay her anything at all? If your husband hit her from behind due to a quick right turn,and no signal, he more than likely was following her too close. If he was far enough behind her to be safe then he wasnt paying attention or simply too slow to react, which is following too close again. She didnt use a signal, so both of you are breaking the law. You are giving the other driver a HUGE break by fixing her car when she has insurance. Its all illeagal. If its your fault ,then you or your insurance pays for a rental. You have saved her more money than a rental would cost already. So, no, dont pay for a rental. What has she done for you? There is no right answer .

Each state has their own laws about vehicle insurance. We live in Michigan, which is considered a "no-fault" insurance state. Basically, this means that your own insurance covers your repairs and medical expenses regardless if you were at fault or the other guy was. The other guy's insurance pays for his repairs and expenses. It is illegal to not have insurance on your vehicle. A newly purchased car can easily be insured with a quick call to your insurance agent so you are covered before you drive the car out of the car lot. If your husband hit a car from behind, then yes, it was his fault. If the police had been called, he would have likely received a ticket for failure to have his car under control and another ticket for not having valid insurance. I would suggest that your dad just fix the car as quickly as possible so she'll have her car back. This is how it works in a no-fault state. However, I had a car accident (hit from behind on the expressway) in San Antonio, Texas in 1999. The lady who hit me got a ticket. It was her insurance company, not mine, who covered everything including repair to my car, medical expenses, rental car, plus meals, lodging, and gas costs since we had to take the rental car home to Michigan before our car was repaired, then we had to drive the rental car back to Texas when the car was finished and then drive back to Michigan again. If you are in a state that is not no-fault, it may just be easier to rent the lady a car until the repairs are done. In the long run, if she pushes the issue and she sues you, it'll cost more money to go to court than to rent her a car for a week.

Sorry but you shouldn't be driving without insurance whatsoever, plain as day. You're at fault and now you gotta pay thorugh the nose, have you had insurance it would cover the cost of a rental for the person.

If you had insurance, full coverage, it would cover renting a car. Technically you are responsible for it. Even though a short stop caused the accident, it would be argued that your husband was following to close.

Your husband is legally at fault, but assuming the police were not involved (which I'm assuming, since the insurance companies weren't notified), you aren't even responsible for fixing her vehicle, much less renting her a car.

This is a bad deal from the start. Do not rent her a car! She probably has uninsured driver's insurance which would fix her car and pay for a rental.

Yes, you do owe her the rental. You are already getting a break that she is agreeing to have it fixed at your father's shop so you can get it fixed for cheaper.
I would check with your insurance though, to see if they would cover this accident. I've seen them cover drivers who get into accidents in a rental/borrowed cars.

First- sorry to break it to you- the driver of your vehicle was ABSOLUTELY 100% NO DOUBT at fault. It is your duty to maintain proper distance from the vehicle in front of you so that in case there is a situation like this- you have time to brake.
Second- you absolutely owe her for repairs on her vehicle (at the shop of her choice) and rental. This is how the insurance would handle it and thats what you owe her.
If you do not give her what she is owed she will likely file through her own carrier who will in turn bill you directly for what they paid out. You are lucky right now that she is agreeing to go through the shop of your choice and should just give her a rental so this doesnt turn any uglier..
