Biscuits pay less tax than cakes and when McVities introduced the jaffa cake, it had to prove to the Customs and Excise that it was a biscuit so that it would attract less tax. Their arguement was that a cake when opened and left out goes hard, whereas a biscuit goes soft. When you leave a jaffa cake out of its packet, it goes soft. Therefore, a jaffa cake, according to McVities, is a biscuit.

They had this Q on Answerbank yesterday. Yes it is a cake (as already said biscuits go soft when stale, a cake goes hard). Also biscuits have a higher tax levy than cakes, and this (Jaffa cakes) had to prove in court that they were indeed cakes not biscuits.
Strangely though most Supermarkets will stock them in the biscuit section!!

Yes. This is how you tell the difference with cakes and biscuits:

A cake is soft when fresh and goes hard when left in the open air.
A biscuit is hard when fresh and goes soft when left in open air.

Therefore a jaffa cake is a cake. This had to be decided upon for the import duties for jaffa cakes.

It's called a cake, therefore it is a cake. Also it carries a virulent strain of cake virus. If you put jaffa cakes in with the biscuits all the biscuits go soft.

The government class it as a biscuit. A few years ago the government took the manufacturers to court as they were not paying tax as they claimed it was a cake.

Ah the age old debate!
as it has a sponge base i would say yes it is a cake although it comes in a pack like biscuits so i don't know.
I'm confused!
